1. The character's first appearance was in a video game: Why Goku and Superman will not be added anytime soon. If the character was created in another form of media and was not originally created in a video game, it likely won't be in Smash.
2. The game featuring the character has been published on a Nintendo console: How characters like Snake, Ryu, Ken, and Joker got in. All Smash characters come from a video game franchise with at least one game published on a Nintendo console. Of course, the issue of intellectual property ownership is a factor that I don't think most of us can accurately account for without disclosure of internal information.
Both these "rules" are going to get broken eventually. The second one has already been stretched way past its original meaning in the past ten years.

I guess they can fight in a court room. or go even meta and dodge yhe text on the bottom and the touch capabilities in a new game.

Or... they could push for Dante.
Y'all, Smash Ultimate is fun as fuck. It's fast action, smooth maneuvering, and balanced fighting techniques across a butt load of characters. I'm bought into the hype.
Nintendo has gone buck wild with the character additions in Ultimate. With the surprise announcements like Piranha Plant and Joker from the Persona franchise, and the knowledge of upcoming Challenger Packs, it looks as if there may be a full range of new fighters Nintendo plans to include.
However, all the "out there" characters that have been added across Smash titles tend to meet two major requirements:
1. The character's first appearance was in a video game: Why Goku and Superman will not be added anytime soon. If the character was created in another form of media and was not originally created in a video game, it likely won't be in Smash.

With that said, I've been thinking about potential characters that meet the two major requirements, have enough notability to be added, and could have a full fighting moveset:
Banjo and Kazooie

Crash Bandicoot
Dixie Kong
Boo
Chris or Jill (Resident Evil)
Waluigi (ffs nintendo just do it)
For now, let's discuss other possible character additions! Who else do you consider as a potential add? Feel free to list characters by likelihood of entry.
It's a long shot, but I'd love to see Arthur Morgan or James Marston from the Red Dead series.

Very, very much a long shot because of the Nintendo publishing theme. Doubt we'll ever see a Rockstar original character.
Phoenix Wright was already in one of the Capcom crossover fighters, it wouldn't be hard to make a moveset for him

I still think Steve is gonna be in, it just makes way too much sense. Insanely popular game, good moveset and stage potential, Nintendo and MS being all buddy-buddy lately...

On the subject of it being stretched I'm referring to Cloud (and the breaking of many fan rules but that's less relevant). The popular line used in fan conversations used to be that the character had to be on a Nintendo console, which Cloud was considered to be a breach of.
Regardless I think we'll be seeing a Lego minifigure sooner rather than later. Shock value has become a key part of SSB advertising.
