He lost his appeal, but the federal bureau of prisons has yet to issue a date to report to prison. Peter Navarro is in prison on a similar charge of contempt of congress.

Updates:
  • The criminal trial of Donald Trump in Manhattan, NY related to the falsification of business records surrounding hush money payments is nearing its end. Closing arguments are expected to happen on Tuesday of next week.

  • Steve Bannon lost his appeal and will have to report to prison for his contempt of congress conviction. No reporting date has been issued yet.
  • Peter Navarro lost his appeal for early release from prison.
  • Mug shots for some of the defendants in the Arizona have been released.
  • Classified documents trial is still going through pre-trial motions.
  • In the Georgia RICO case, the Fulton County court has sent lots of documents to the appeals court for the matter of the disqualification of Fani Willis and her office. The defendants mostly lost in the Fulton County court and have appealed the judge's ruling.
  • Still waiting on SCOTUS to rule on Trump's immunity appeal for the January 6th case.

I think they're pretty much guaranteed to. They've been conducting themselves well during the trial and it would be shooting themselves in the foot to not do so and just let the Defense's statements be the last lingering thoughts for the jury. Also the fact that the hard end date (for lawyers as they're making closing statements on that day) is next Tuesday to me indicates there's going to be a day or 2 of prosecution redirect.

Alright, I may have been wrong about them not calling any witnesses. No idea what they think it could accomplish, I imagine it wouldn't amount to anything beyond "Yeah I knew Cohen, that fucking shitbag".

All they have is character assassination of the prosecution's witnesses. There is no defending Trump's behavior or discounting the physical evidence.

It'd be nothing but "I don't recall" and "5th Amendment, bitches". He can't be compelled to say anything until the defense opens the door.

Because defendants can't be made to testify against themselves.

Anyway, hoping he'll officially be a convicted felon by the end of this topic.

Just FYI, you don't have to scroll to find where you left off in your AMP. If you click the blue dot on the topic in your AMP it will take you to the top of the newest posts right where you last read.

With that said, I do prefer to have the topic tracked because I like to see how many new posts are in before I even enter.

Man wtf the prosecution is really going to let the defense's representations of Cohen be the last lingering thoughts for the jury on Cohen? Wasn't expecting that.

There was a very long sidebar that stretched all of lunch and even kept the jury out for an extra half-hour where the DA was looking to bring in CSPAN footage that showed Trump was with his bodyguard (Schiller) at the time Cohen called him. You'll recall this is the phone call the defense attacked Cohen on and claimed instead of talking to Trump about Stormy he was really talking to Schiller about a prank caller.

This CSPAN footage showed Trump was with Schiller five minutes before the call was made leaving pretty much no doubt Trump was there to take the call. Obviously it doesn't show anything about what they talked about but it removes an avenue of doubt from "Was Trump even there to take the call?"

After strenuously fighting against it being let in, the defense caved when it became clear that if they didn't agree to it here and now it would still come in - just they'd have to get the C-SPAN witness back in court and the DA had already had arranged a flight for him to be back in NY and ready to go 9:30 AM tomorrow. So the DA was able to present it to the jury and did first thing after they were brought back in after lunch.

So I think they did push back on some of the portrayal of Cohen.

I'd imagine they already have most of it baked into their closing arguments. They know Cohen is a piece of shit and they knew the Defense was going to go after it. You can't really defend the guy against being a piece of shit, so I'm going to guess closing arguments for the prosecution are going to hammer on the paper trail and that anything else about Cohen isn't particularly relevant here.

I want every single Trumper lawyer to be disbarred and brought up on possible criminal charges (where applicable) for their deplorable behavior and conduct within the courts. I know defense attorneys will do anything and everything to defend their client, however all of Trump's lawyers seem to openly have contempt for his judges and them trying to conduct a legitimate and sane trial.

Trump attorney Emil Bove says the defense does not expect to call any witnesses after Robert Costello.
The judge notes that can change.

Is this something they have to do to lay groundwork for an appeal? Like if they're going to appeal on these grounds they have to show in the record that they moved for the original case to be dismissed on the same grounds?

The defense calling for a dismissal when the prosecution rests is just standard procedure.

Would Trump be in court if he had reimbursed Pecker for the $150k he paid to kill the McDougal story out of his own pocket?

He stiffed Pecker for that, which led to Pecker not picking up the tab for the Stormy story, which led to the reason why he's in court now.

It would be poetic justice if Trump becomes a felon over a measly $150k.

If Trump had paid Daniels money to not talk about it, and paid out of his own pocket, he'd likely not be in trouble. Probably a campaign finance violation, but that I think is a misdemeanor.

If you're a defense attorney, you have to motion for dismissal when the prosecution rests. You gotta motion to set aside the verdict if you lose. You gotta appeal with whatever will stick. You just have to.

Maybe they will include it in closing, however I feel like that would be unnecessary to do so. I'd think it more logical to immediately counter their narrative and use the closing arguments to solely focus on Trump's criminality and how all of the physical evidence points to his culpability. Adding in extra stuff I worry would make it bloated and the more the jury has to remember the less they'll remember.

Yeah, that's what I thought. The prosecution's case is that a misdemeanor committed to hide another misdemeanor elevates them to a felony.

If only he wasn't so cheap to pay it out of his pocket. They got Al Capone on tax evasion, it would be nice to put Trump in that class.
