No but the threat of spending some time in prison anyways and wasting money and time in court is still real.

I have always said that burning the US flag is the most legitimately patriotic thing that a US citizen can do as a symbolic gesture. It is 100% harmless. It symbolizes the freedom to criticize the government. Without that freedom, no other freedoms can be guaranteed. So of course the GOP has been demonizing the act for decades. The final push to make it illegal is transparently authoritarian, and utterly unsurprising.
