He has little chance of winning a summary judgement, but he can contest the facts. The accuser has the burden of proof.

There is easily going to be physical evidence of the stun, but the motives could be contested, and the accuser has the burden of showing motive which is what the hate crime charge turns on. A hate crime's evidentiary standard is by the "preponderance of evidence", which is a lower standard than "beyond a reasonable doubt." It essentially means "more likely than not."

There are definitely a few situations in which I would think it's acceptable for an employer to yell at an employee, like gross negligence or incompetence that seriously injures the business deal or something.

That said it's probably not justified in the vast majority of cases where stuff like that happens.

I'd say even then just do what needs to be done (termination, write-up, suspension) and be done with it.

I think most people would be more understanding of what he did wrong if he was dealt with in a civil manner.
