A few things I do like about this: The fact that the FTC understands that there exists animated programs that can appeal to all ages (whether this includes animated shows like South Park that are intended for older audiences, doesn't say). If that's the case then hopefully there's some understanding that video games, in particular, have appeal to more than just children under 13. Second, while $42,000 is roughly the maximum fine they could do they'll take multiple factors into consideration to determine what to hit the offender with, how big a "business" they have and what the impact would be on it.

It's a start, I'll say. Here's hoping they change more about this for the better, putting in protections for content creators who are aiming their content at audiences other than the below-13 age group (despite the inclusion of things like Mario or Pokemon, stuff that would attract children but have just as much appeal to all other ages).

No one said that. It was YouTube's fault that happened, but the creators are getting severely punished for something they had no control over, and it's bullshit.
