First, the 5th amendment contains a lot of things other than just the ability to not self incriminate in a criminal case. It gives people a lot more than just that right. Sticking to what you are talking about though, the right to not incriminate yourself goes beyond just the crime you are being accused of and a person can invoke the fifth to protect from incriminating themselves for another or different crime. Lets say someone was embezzling money from a company they worked for and up on criminal tax fraud in relation to the extra money. They could theoretically invoke the fifth when being asked about the origins of the money and it wouldn't necessarily have anything to do with the fraud elements. You can also think of it more like protection against the unknown or a requirement that the government is able to support the case and facts against you on its own without relying on the threat of contempt to make you confess to a crime you didn't commit. If they let the robbers go because the robbers surround themselves with civilians, theoretically the robbers could avoid the police indefinitely. It isn't realistic to expect the police to follow the robbers without taking action for hours until the time is right. That would cost a lot of money and would be deemed as inefficient. Then add on the fact that the robbers are driving recklessly and have no regard for the lives of innocents, it makes sense to close them in. When they are closed in, the robbers start shooting at the police and it leads to a shootout until the robbers are eventually killed. Stop being reasonable and making sense. I golf on average about once a week and am decent compared to most people (15 handicap). I went with a group of people that aren't golfers and I didn't get why they were having fun. I mean they could barely hit the ball and didn't have a chance at hitting the targets. Why spend all that money to top balls 10 yards off the tee and pay for over priced food and drinks? For me it was kind of like a higher tech driving range session. I bought some real short term calls on Carmax a month or so ago the week before they reported earnings. The stock went up like 7% the day after I bought it (two days before earnings) then they reported better than expected earnings and the stock plunged for no apparent reason destroying my contacts. Then last week I had longer term puts on a Chillean bank that expired 11/15. (the country was in chaos lets bet the bank will suck -- makes sense and was working). They were in the money for two weeks and I was up almost $1000 on just two $25 options. They day they were set to expire the stock rallied 14% to destroy my gains and then this week its back down to where I would have made some money. It literally just jumped the day my option was expiring for no reason. Currently my 37$ AMD puts are getting crushed.
