I would hazard a guess that the main reason that Chapter 31 does not include simple topless photos of children is because they don't want parents going to prison for taking pictures of their toddlers in diapers.

interesting take. i seem to remember that being some sort of big issue with parents getting in trouble or almost getting in trouble for some clearly innocuous photos.

In fact, the very next Chapter of the DC Criminal Code (regarding Sexual Performance Using Minors) has definitions that do not strictly include being topless as a form of "Sexual Conduct" and, even if they did, specifically excludes the minors depicted in the "Sexual Performance" from liability for possessing or transmitting the "Sexual Performance" unless at least one of the minors depicted does not consent to its transmission.

Ergo, it would appear to be completely legal for Claudia Conway to possess a topless photo of herself, and not "equally illegal", as you stated.

couple of things:
i said possessing it was equally illegal, and you snipped off the part where i said her mom had the added caveat of distributing.

second, can you post a link to the criminal code you are referring to as well as indicating any relevant section numbers? i am genuinely curious to read it.

if what youre saying is right, (im assuming it is) then clearly DC's criminal code differs from elsewhere, considering (as someone else was kind enough to prove for me) at least one kid HAS been charged for having their own child porn in the US.

if thats the case i am happy to stand corrected.

it was a neutral phrase because i am neutral about it. what the daughter did WAS illegal. its an objective statement, and not one that i necessarily agree or disagree with on moral grounds. its not my place to say, because i am so far removed from a place where my opinion on the matter would be relevant.

i already mentioned it would be impossible to have such an example as any sort of case like that would be sealed for sure.

they dont make the victims (who in this instance would also be the criminals i guess?) public in child porn cases and rightly so. that would be a super fucked up thing to do to a kid who has already been through a traumatic experience.

look ya'll, the only reason its even still being discussed is because people for some reason felt the need to argue with me.

all i did was say the law exists. i didnt say i was for it, or against it. its not my place to say. im not a judge or lawyer, im not a parent, im not a child, and i didnt have any of that sort of experience when i was her age. it is not my place to say, so im not going to.

im sure there are good reasons on both sides as to why this law should or should not exist, and im sure most people making the argument either way are doing it because they either want to protect kids or protect their freedoms, and we should at least be able to come together on the fact that we all just want what is best for them.

only reason i even brought it up was because someone mentioned ~3 pages in that the photos came from her daughters phone, so it instantly clicked in my head that "wait, thats illegal".

also if you think kellyanne's soulless legal team isnt going to try to use that as some sort of half assed attempt at a legal defense for her shitty actions, or as another petty attack on her daughter, you are kidding yourself. that woman is above nothing.

i sort of understand it. wouldnt say i agree with it, but im guessing the logic is that whoever owns them, those pictures are still child porn. they can still spread to other people. its not unreasonable to assume that a kid taking nude pictures is likely taking them to share with someone, and if it goes to one other person then it is likely going to end up going to 10 other people and if it goes to 10 other people then its going to go to 100 more and eventually its going to end up in the hands of a pedo somewhere. i feel like the law, however misguided, is meant to protect kids, theyre just doing so by putting them in legal jeopardy instead.
