He copied the pose, which is entirely acceptable if you use a different character. But this guy decided to do the same character, and made an inferior work in his "style". This is why people choose other characters, so your not compared to others and seen as a hack. Top it off, the original art was fanart, and this is a commission. Highly unethical.
