The Duluth YMCA has banned a race official from future swim meets after she told a Black student she could not compete in a race on Sunday because she was wearing a swimsuit displaying the words "Black Lives Matter."
The meet was held at the Superior High School and sponsored by the Duluth YMCA. Leidy Lyons, 12, wore the swimsuit after hearing about the fatal police shooting of Amir Locke a Black man who was shot and killed by Minneapolis police officers while executing a no-knock search warrant.
According to the Duluth YMCA, an independent volunteer official temporarily barred the student-athlete from taking part in the meet, stating the words on her swimsuit "went against USA Swimming's policy of no political language."
According to Classie Dudley, President of the Duluth Branch NAACP, the volunteer official gave the option for the swimmer to change into a different swimsuit, but she did not. Dudley said she was called by Leidy's mother after the official barred Leidy from participating further in the meet. Dudley then went to Superior High School to show her support.
"The official originally stated that it was politically motivated and that it goes against their policy of no political speech," Dudley told the Duluth News Tribune. "Leidy is 12 and she's trying to share the fact that she matters. There's nothing political about that."
The official then changed her reason for dismissal to the size of the logo, instead of political speech. "I didn't want to entertain that because it was obviously untrue," Dudley said. "Even if it was too big, Black Lives Matter isn't a logo like Adidas. And if you're telling me that Black Lives Matter has been whittled down to a political statement or a logo, then you're basically telling me that Black lives don't matter."
In response to the official's ruling, Duluth YMCA staff disputed the claim and contacted the YMCA leadership. Within 10 minutes of Dudley's arrival, the vice president of the Duluth Area Family YMCA arrived and quickly overruled the decision to disqualify Leidy and she was able to compete in the race.
The Duluth YMCA said they are working alongside the swimmer's family and will work to hold independent officials accountable for further education to address systemic racism.
The volunteer race official was removed from the meet and will be banned from any further Duluth YMCA-hosted swim meets.

A Long Island grandmother outsmarted scammers who tried to steal thousands from her.
The woman from Seaford, who asked to be identified as Jean, told CBS2 that she received a call from someone claiming to be her grandson. The man said he was arrested for drunk driving and needed to be bailed out of jail.
"I knew he was a real scammer. I just knew he wasn't going to scam me," Jean, 73, told CBS2. "He starts calling me 'grandma,' and then I'm like, I don't have a grandson that drives, so I knew it was a scam."
The scam took several phone calls to play out and involved multiple unidentified males, police said in a press release. One person claiming to be a lawyer for Jean's grandson told her that he needed $8,000 to get out of jail. A third person called claiming to be a bail bondsman coming to collect the money.
"I told him I had the money in the house, and I figured, he's not going to fall for that," Jean said, adding that she called the police. "Well, he fell for that hook, line, and sinker."
A man impersonating a bail bondsman arrived at Jean's home to collect the money, and she handed him an envelope filled with paper towels. As he turned to leave, police officers tackled him, according to CBS2.
Officers of the Nassau County Police Department arrested Joshua Estrella Gomez, 28, and charged him with attempted grand larceny in the third degree. He was released on an appearance ticket and is due to appear in court on February 3.
"I feel like gotcha, and I feel like, like you say, so many people fall for this and you only hear about it on the other end after they've lost $8,000," Jean said.
Nassau County PD spokesperson Richard Lebrun told Insider that people should block unwanted calls and texts to avoid being scammed. If someone calls claiming to have been arrested, call that person or a family member to confirm.
"Resist the pressure to act immediately," Lebrun said in a statement. "Legitimate business will give you time to make payments."
"Never pay with gift cards or wire money to an unknown person or business," he added.

Police say the fatal shooting of a Georgia man earlier this month was accidental after a toddler found a handgun and fired it.
Dustin Walters, 25, was shot on Dec. 5 in Savannah, Georgia. The Savannah Police Department said officers responded to the incident at around 5:30 p.m. that day over reports of a shooting and found Walters injured.
He was transported to Memorial Medical Center, where he succumbed to his injuries.
In a statement Tuesday, the Savannah Police Department said the shooting was accidental after it was determined that Walters was wounded when a toddler, under the age of 2, "found and fired the handgun," striking him.
Police did not specify the relationship between Walters and the child.
As a parent, I cannot imagine what this family is going through or will continue to go through in the coming years," Savannah Police Chief Roy Minter said.
"What we want to make sure now is that parents are aware that although rare, these incidents can happen with tragic results," Minter said. "Please take this seriously and take the steps to ensure that you and your family members are safe.

Accused Oxford High School shooter Ethan Crumbley's parents, James and Jennifer Crumbley, have each been charged with four counts of homicide involuntary manslaughter.
The charges were filed in 52nd District Court in Rochester Hills, Michigan, Friday morning.

A Washington state father killed his daughter's 19-year-old boyfriend for selling her into a sex trafficking ring, police said.
The boyfriend's remains were discovered in the trunk of an abandoned car on East Everett Avenue in Spokane last month, police said in a press release Monday. Investigators believe the victim was killed in November 2020.
The girl's father, John Eisenman, 60, was charged with first-degree murder and is being held on a $1 million bond. Attorney information was not listed for him.
Police said Eisenman learned in October 2020 that his juvenile daughter had been sex trafficked in the Seattle area and "obtained information" that her boyfriend was responsible, according to the press release.
Eisenman was able to rescue his daughter and get her back to Spokane that same month, police said.
When the father learned that his daughter's boyfriend was going to be at a location in Airway Heights, Eisenman drove there and waited for the 19-year-old to arrive.
"During that encounter Eisenman abducted the victim, tying him up and placing him in the trunk of a vehicle. Eisenman subsequently assaulted the victim by hitting him in the head with a cinder block and then stabbed him repeatedly, causing his death," police said. "After the homicide, Eisenman drove the vehicle to a remote area in North Spokane County and abandoned the car with the body still inside."
The car remained in the remote area until last month when a person drove it to Spokane and left it on East Everett Avenue. The remains were discovered after people began rummaging through the abandoned vehicle.
Amber Hellmann said her boyfriend and a friend were working outside and noticed that the car had been left on their street for a while.
"They were just looking around and for some reason, they decided to look in the trunk and all I hear is, 'there's a body,'" she told NBC affiliate KHQ-TV of Spokane.
Authorities said they do not believe the person who moved the car was aware that a body was in the trunk.

The families of nine people fatally shot in 2015 at a historically Black church in Charleston, South Carolina, have reached an $88 million settlement with the Justice Department in their lawsuit over the shooter's weapon purchase, according to agency officials and a news release Thursday.
The settlements range from $6 million to $7.5 million per claimant for those killed at Emanuel African Methodist Episcopal Church and $5 million per claimant for survivors, the Justice Department said.
The widow of the Rev. Clementa Pinckney thanked supporters and those involved in reaching the settlement.
"Even though Clementa is not with us here physically, I know spiritually he is with us, and I know that he's smiling down on us right now," Jennifer Pinckney said Thursday.
"He will be missed, along with all the others that didn't survive that night."
The nine victims killed ranged from 26 to 87 years old. They were Pinckney, the Rev. Sharonda Coleman-Singleton, the Rev. DePayne Middleton-Doctor, the Rev. Daniel Simmons, Cynthia Hurd, Susie Jackson, Myra Thompson, Ethel Lance and Tywanza Sanders.
A federal appeals court ruled in 2019 that families of those slain could sue the US government for negligence over lapses in the FBI background check that allowed the shooter to buy the semiautomatic pistol used in the massacre.
****** ****, an avowed White supremacist, was convicted of federal murder and hate crimes charges. He was sentenced to death in 2017 and has appealed his conviction.
Before the massacre, **** had been arrested on a drug charge that should have prevented him from purchasing the gun had the charge been properly reported during the background check, the appeals court found in 2019.
Had the background check been performed properly, "no one disputes" it would have kept him from buying the gun, the court wrote.
Shortly after the Charleston massacre, federal lawmakers made a bipartisan demand for tough background checks on gun purchases.
The House passed the Bipartisan Background Checks Act of 2021 in March. But the bill has not gone before the Senate.
After an Office of Inspector General's audit in July, the FBI said it would consider modifying the background check system known as National Instant Criminal Background Check System (NICS) after an 18-year-old Florida resident traveled to Colorado in 2019 to buy a shotgun.
The NICS system, which is used by licensed federal firearms sellers and dealers, did not have the capability to verify the buyer was a resident in Florida, which prohibits the sale of firearms to anyone under 21.

A US Capitol Police officer was attacked on Friday morning by a woman carrying a baseball bat along First Street SW in Washington, Capitol Police said in a statement.
The incident happened around 9:30 a.m. ET. When police approached the woman, she became agitated and raised her bat. Officers tried to take the bat from her, and during the scuffle she bit one of the officers, according to Capitol Police.
Police identified the woman as 25-year-old Olivia Romero. Charges are pending.
The incident is the latest attack in what has been a dangerous year for Capitol Police officers. The January 6 riot injured more than a hundred law enforcement officers, and in April, a Capitol Police officer was killed after a suspect rammed a vehicle into a police barricade outside the Capitol building.
In August, a man with a history of supporting former President Donald Trump and who has said "all Democrats need to step down" was arrested after an hours-long standoff near the US Capitol during which he claimed to have an explosive device. Weeks after that, Capitol Police arrested a California man who had multiple knives in his truck, which had a swastika and other White supremacist symbols painted on it, near the Democratic National Committee headquarters.

A Texas public health doctor fired earlier this year for using leftover doses of Covid-19 vaccine on eligible individuals is suing Harris County for $1 million, saying he was fired for giving "the vaccine to too many individuals with 'Indian' sounding names."
Dr. Hasan Gokal was charged with theft by a public servant but a Harris County grand jury declined to indict him, according to Harris County District Attorney Kim Ogg's office.
Gokal was a medical advisor for Harris County Public Health (HCPH) and was involved with the county's first distribution of the vaccine on December 29, 2020, according to the lawsuit filed in Harris County Tuesday.
The vaccination distribution site Gokal was supervising shut down with 10 doses of Covid-19 vaccine left in an already-opened vial. Gokal first asked people at the site if they wanted to be vaccinated, according to the lawsuit, but most had already received the vaccine.
Gokal then called a superior at HCPH and informed them he was going to find people to give the vaccine to, and the superior affirmed his decision, the lawsuit said.
The doctor then contacted as many people as he could to find eligible recipients for the leftover doses, the lawsuit said.
"I did what any physician would do, which is take resources meant for patients and people and give it to them instead of throwing them away. And that's why it was so infuriating," Gokal said, according to a statement from his attorney's office.
His attorney at the time, Paul Doyle, said Gokal vaccinated several eligible individuals, including his wife, who had an underlying medical condition, after another person who was going to receive the vaccine suddenly said he was unavailable, CNN reported earlier this year.
Gokal was told by HCPH Human Resources that he "did not 'equitably' distribute the vaccine and that Dr. Gokal gave the vaccine to too many individuals with 'Indian' sounding names," the lawsuit says.
HCPH also told Gokal he "should have instead thrown the vaccines away," according to the lawsuit.
"It's very clear that if he had vaccinated people named Anderson, Smith and Jones he would have been called a hero and not have been fired, charged, vilified and brought before a grand jury that thankfully refused to indict him," Gokal's attorney Joe Ahmad said in the statement.
HCPH "violated" Gokal's rights "by discharging and otherwise discriminating against him on the basis of his South Asian race and Pakistani national origin," the lawsuit states.
"Gokal has not only suffered lost wages and back and front pay, but other pecuniary losses, emotional pain, suffering, mental anguish and loss of enjoyment of life," the lawsuit says.
CNN has contacted the Harris County Attorney's Office for comment but did not hear back. Harris County Public Health said they are not commenting on the lawsuit.

Minnesota's highest court on Wednesday vacated former Minneapolis police officer Mohamed Noor's third-degree murder conviction for the fatal shooting of Justine Ruszczyk while responding to her 911.
The court said there was insufficient evidence to sustain the conviction and ordered that he be sentenced on his conviction for second-degree manslaughter.
This ruling supersedes a previous appeals court decision in February against Noor that opened the door to reinstating a third-degree murder charge against former Minneapolis Police Officer Derek Chauvin, who was convicted in April on state murder charges in George Floyd's death.
Mary Moriarty, the former Chief Hennepin County Public Defender, said she does not believe the decision will affect Chauvin's case because his second-degree murder conviction has not been reversed. Chauvin was only sentenced on the most serious charge of second-degree murder, per state sentencing guidelines.
Noor was sentenced in June 2019 to 12 years in prison.
The 33-year-old Somali American was convicted in April of that year on charges of third-degree murder and manslaughter in the 2017 death of Ruszczyk, who had relocated from her native Australia to Minneapolis to live with her fianc.
CNN has sought comment from the attorneys of Mohammed Noor and Ruszczyk's family as well as the Hennepin County Attorney's Office.
At Noor's trial, his lawyer argued that a "perfect storm" of events led to him opening fire on Ruszczyk the night of July 15, 2017, when she called 911 to report a possible assault in progress in an alley behind her Minneapolis home.
Noor testified that he feared for his partner's life as Ruszczyk approached their squad car in the dark, empty alley. But Hennepin County prosecutors said Noor overreacted and failed to properly assess the situation before firing a gunshot into Ruszczyk's abdomen.
Ruszczyk's death drew widespread attention, in the United States and in her native Australia.

Virginia Gov. Ralph Northam granted posthumous pardons Tuesday to seven Black men who were executed in 1951 for the rape of a white woman, in a case that attracted pleas for mercy from around the world and in recent years has been denounced as an example of racial disparity in the use of the death penalty.
Northam announced the pardons after meeting with about a dozen descendants of the men and their advocates. Cries and sobs could be heard from some of the descendants after Northam's announcement.
The Martinsville Seven," as the men became known, were all convicted of raping 32-year-old Ruby Stroud Floyd, a white woman who had gone to a predominantly black neighborhood in Martinsville, Virginia, on Jan. 8, 1949, to collect money for clothes she had sold.
Four of the men were executed in Virginia's electric chair on Feb. 2, 1951. Three days later, the remaining three were also electrocuted. All of them were tried by all-white juries. It was the largest group of people executed for a single-victim crime in Virginia's history.
At the time, rape was a capital offense. But Northam said Tuesday that the death penalty for rape was applied almost exclusively to Black people. From 1908 when Virginia began using the electric chair to 1951, state records show that all 45 people executed for rape were Black, he said. The pardons do not address the guilt or innocence of the men, but Northam said the pardons are an acknowledgement that they did not receive due process and received a racially-biased death sentence not similarly applied to white defendants.
These men were executed because they were Black, and thats not right, Northam said.
Their punishment did not fit the crime. They should not have been executed, he added.
All seven men were convicted and sentenced to death within eight days. Northam said some of the defendants were impaired at the time of their arrests or unable to read confessions they signed. He said none of the men had attorneys present while they were interrogated.
Before their executions, protesters picketed at the White House, and the governor's office received letters from around the world asking for mercy.
James Walter Grayson is the son of Francis DeSales Grayson, who was one of the seven. He sobbed loudly when Northam told the family members he would grant the pardons after meeting with them Tuesday. Thank you, Jesus. Thank you, Lord, he said, as he wept while being embraced by two other descendants of the men.
Grayson said he was 4 years old when his father was executed.
It means so much to me, he said of the pardon.
I remember the very day the police came to the door. He kissed us and they took him away, he told The Associated Press in an interview after the announcement.
Rudolph McCollum Jr., a former Richmond mayor who is the great-nephew of Francis DeSales Grayson and the nephew of another one of the executed men, Booker T. Millner, told Northam the executions represent a wound that continues to mar Virginia's history and the efforts to move beyond its dubious past. He wept when Northam announced he would pardon the men.
In December, advocates and descendants of the men asked Northam to issue posthumous pardons. Their petition does not argue that the men were innocent, but says their trials were unfair and the punishment was extreme and unjust.
The Martinsville Seven were not given adequate due process simply for being black, they were sentenced to death for a crime that a white person would not have been executed for simply for being black, and they were killed, by the Commonwealth, simply for being black,' " the advocates wrote in their letter to Northam.
The seven men, most in their late teens or early 20s, were: Grayson, Millner, Frank Hairston Jr.; Howard Lee Hairston; James Luther Hairston; Joe Henry Hampton; and John Clabon Taylor.
Eric W, Rise, an associate professor at the University of Delaware who wrote a 1995 book on the case: The Martinsville Seven: Race, Rape, and Capital Punishment, said Floyd told police she was raped by a large group of Black men and testified at all six trials. Two of the men were tried together.
All seven men signed statements admitting they were present during the attack, but they had no access to their parents or attorneys at the time, Rise said.
The validity of the confessions were one of the things their defense attorneys brought up at the trials, Rise said.
Four of the men testified in their own defense. Rise said two men said they had consensual sex with her, one man denied any involvement, and another man said he was so intoxicated he could not remember what happened.
Northam has now granted a total of 604 pardons since taking office in 2018, more than the previous nine governors combined, his administration announced Tuesday.
This is about righting wrongs, Northam said. We all deserve a criminal justice system that is fair, equal, and gets it right no matter who you are or what you look like," he said.
In March, Northam, a Democrat, signed legislation passed by the Democrat-controlled legislature abolishing the state's death penalty. It was a dramatic shift for Virginia, a state that had the second-highest number of executions in the U.S. The case of the Martinsville Seven was cited during the legislative debate as an example of the disproportionate use of the death penalty against people of color.

A Jacksonville mother has lost two of her adult sons to COVID-19. She also caught the virus with them.
She was vaccinated. They werent.
Its a parents worst nightmare, said a teary-eyed Lisa Brandon. The only reason Im doing this is to put the word out to please get vaccinated.
She lived with her sons on the Southside and said everyone got sick in late July.
But Aaron Jaggi, 35, and Free Jaggi, 41, got worse. So she took them to the hospital. Both contracted double pneumonia. Both were admitted into the intensive care unit and ultimately put on ventilators.
Free died on Aug. 12. Aaron passed away on Aug. 13. They died within 12 hours of each other.
This is horrible. I love my boys, said a weeping Brandon. They never made it home.
Brandons now lost all three of her children: her son David passed away five years ago.
My boys, they were my life, she said. Thats all I lived for, for them.
Brandon said she took the Moderna vaccine and credits that for her mild case. She said she couldnt convince her sons to get immunized.
I think they would be alive today if they would have gotten their shot, she said. I wouldnt have gotten it as bad. I wish I could have made them do it. And now its too late.
As she deals with loss and an empty home, which she now has to move out of because they shared rent, she hopes others learn a lesson from her terrible tragedy.
Family friends are trying to support her however they can.
I think Aaron and Free would be just blown away to see how many people cared about them, said family friend Brittany Pequignot. And how many people are stepping up to help their mom out in this tough time.

The comedian Horatio Sanz is accused in a lawsuit of grooming a teenage girl and sexually assaulting her while he was a cast member on "Saturday Night Live."
The suit was filed Thursday in New York City Supreme Court in Manhattan and obtained by NBC News via the girl's attorney. It alleges the girl was assaulted on numerous occasions beginning in 2000 when she was 15 and Sanz, who was on the show from 1998 to 2006, was 31. The comedian, SNL Studios and NBCUniversal, the parent company of NBC News, are listed as defendants.
Andrew Brettler, an attorney for Sanz, said in a statement that the allegations are "categorically false." SNL Studios and NBCUniversal said they do not comment on legal matters.
The lawsuit alleges that the girl, identified as Jane Doe, was a superfan of "SNL" and would post about the show on a website she ran. In January 2000, Sanz and fellow cast mate Jimmy Fallon emailed the 15-year-old from an NBC account, according to the suit.
It does not state the nature of the email but alleges Sanz then "began his process of grooming" the teen. In October of that year, she met with Sanz at NBC following a taping of "SNL," the lawsuit states.
Sanz, according to the suit, was flirtatious and physically affectionate with the girl and kissed her on the cheek and put his hands on her waist. The lawsuit says he was 31 years old at the time.
For the remainder of 2000 and going into 2001, the girl would travel from her home in Pennsylvania to New York to wait in the standby line for tickets to "SNL," the lawsuit claims.
In May 2001, when she was 16, the girl was allowed into an "SNL" party, according to the lawsuit. It claims that Sanz and other cast members, including Fallon, saw the girl drinking alcohol but did not stop her. According to the suit, they either "knew or should have known that Plaintiff was under the legal drinking age.
Fallon's team did not immediately respond to a request for comment.
The girl was then invited to several other "SNL" parties where she was served alcohol and would engage in drug use, the suit states.
At one party in May 2001, Sanz allegedly "signaled Plaintiff over and guided her to sit on his lap" while he told a story to a group of roughly 10 people, including NBC employees, the lawsuit said. It alleges that Sanz had his arms around the teen's hips, waist and buttocks and no one intervened.
About three months after the party, Sanz allegedly began contacting the girl on Instant Messenger and would send her leaks on "SNL" hosts and musical guests to post on her website, the lawsuit states.
It says that the messages "started an incessant exchange of communications in which defendant Sanz groomed and molested Plaintiff."
"In these communications with plaintiff, Sanz regularly and repeatedly asked for photos of her," the suit alleges.
Defendant Sanz exchanged messages with plaintiff and steered conversations to discuss sex, sexual experiences, sexual activities, sexual fantasies, masturbation and Sanz's instruction of plaintiff in sexual acts.
The lawsuit goes on to describe several more instances of the girl attending "SNL" parties, including one where she and Fallon allegedly discussed what she planned on doing after graduating high school.
Plaintiff was never asked by anyone for identification before being served alcohol and, despite plaintiff being underage, she was continually permitted by NBC employees to consume alcohol and attend the parties regularly, including on at least four occasions in winter and spring of 2002," the lawsuit says.
In May 2002, Sanz allegedly gave the girl, then 17, a ride in a limousine. The lawsuit says she attended two "SNL" parties and Sanz allegedly acted inappropriately by "kissing her, groping her breasts, groping her buttocks, and digitally penetrating her genitals" without her consent.
The lawsuit alleges that the assault happened around several attendees, including NBC employees. It says that one person who witnessed it said to Sanz, Are you f------ serious?
The girl became "depressed, ashamed and self-loathing" and sought treatment, the lawsuit states. It says that in 2019, the girl ran into Sanz at a comedy event. He allegedly "admitted and bragged to plaintiff that he masturbated during their conversations when she was underage," according to the suit.
It claims that Sanz later sent the girl text messages apologizing for his actions. "I was a creep but a wounded creep. And Ive tried to make amends since quitting drinking, one alleged text read.
Sanz's attorney said in his statement that prior to the lawsuit being filed, the girl demanded $7.5 million "in exchange for her silence," and that Sanz and his attorney refused.
"However often she repeats her ludicrous allegations or tries to rope in other high-profile names to generate media attention, they will always be false," Brettler said, calling the claims "totally meritless."
The lawsuit also accuses another "SNL" cast member of openly sexually harassing the accuser's friend when she was 17 and alleges a person with NBCUniversal's Page Program grabbed the accuser "sexually." The suit does not name the other cast member or the person in the program, which is designed to prepare early-career professionals for entry-level roles at the company.
