Prosecutors have recommended probation in a plea deal for Jamarcus Glover, the man whose drug dealing led Louisville police to the home of Breonna Taylor in March 2020.

According to court documents obtained by NPR, Glover entered guilty pleas last week. Prosecutors have agreed to drop most of the charges he faced and are recommending up to 8 years of probation.

The circumstances of Taylor's death killed by police late at night in her own home as they arrived to execute a search warrant for an ex-boyfriend's crimes helped fuel a nationwide movement calling for racial justice and an end to police brutality and led to moderate reforms of the Louisville police department.

Lawyers for Taylor's family have maintained that Louisville Metro Police Department's tactics, including no-knock warrants and coordinated late-night raids, were out of proportion with the crimes Glover was suspected of committing. That point, they said Tuesday, was underlined by the prosecutor's recommendation of probation.

"It's a tragic reminder of how a ridiculous, militarized operation was the catalyst for a 26 year old's woman's murder," Sam Aguiar, a lawyer who represented Taylor's family, wrote in an email to NPR. "They were treating these guys like they were each Pablo Escobar, when in reality they were low level offenders."

At the time of the raid, Glover and an associate named Adrian Orlandes Walker were wanted by police for suspected involvement in a drug dealing ring that operated out of vacant homes in west Louisville.

Glover and Taylor had dated off and on for several years, according to her family's lawyers, but had broken up by then. Glover has consistently maintained that Taylor was not involved in any drug dealing.

Louisville police obtained several search warrants for different locations where they believed Glover and Walker had operated. That included Taylor's apartment, which police said had been used by Glover to receive mail and possibly stash money or drugs.

Early in the morning of March 13, Glover was apprehended by Louisville police and arrested. About the same time, 10 miles away, police raided Taylor's apartment.

Officers pounded on the door before forcing entry. Inside, Taylor was asleep alongside her boyfriend Kenneth Walker, who is not related to Adrian Walker.

Taylor's boyfriend, believing intruders had broken into the apartment, fired a single shot that struck an officer in the leg, after which police opened fire. Taylor, hit by six bullets, was killed.

No officers were charged in her death. Two LMPD officers who were involved were fired in January. A third retired earlier this year.

Last year, prosecutors drafted a plea deal that would have required Glover to serve 10 years in prison and implicate Taylor as a co-defendant, Glover declined.

The current plea agreement requires Glover to forfeit money and vehicles seized by police during their investigation and allows him to move out of state, according to court records obtained by NPR. He is scheduled to be sentenced next month.

Minnesota's highest court on Wednesday vacated former Minneapolis police officer Mohamed Noor's third-degree murder conviction for the fatal shooting of Justine Ruszczyk while responding to her 911.

The court said there was insufficient evidence to sustain the conviction and ordered that he be sentenced on his conviction for second-degree manslaughter,a lesser charge.

This ruling supersedes a previous appeals court decision in February against Noor that opened the door to reinstating a third-degree murder charge against former Minneapolis Police Officer Derek Chauvin, who was convicted in April on state murder charges in George Floyd's death.

Mary Moriarty, the former Chief Hennepin County Public Defender, said she does not believe the decision will affect Chauvin's case because his second-degree murder conviction has not been reversed. Chauvin was only sentenced on the most serious charge of second-degree murder, per state sentencing guidelines.

Ruszczyk's former fianc 'deeply saddened' by decision

In a statement, Noor's lawyers and his family praised the decision.

"They have had a long journey; now fairness has been delivered to a person who is a devoted to his community," the statement said, quoting their client as saying "with hardship comes ease" and that he looking forward to hugging his son as soon as possible.

"We have always maintained that this was a tragic case, and we are grateful for an exceptionally well-reasoned and unanimous opinion from this State's highest court."

The Minnesota Supreme Court decision said a person's mental state must show a "generalized indifference to human life, which cannot exist when the defendant's conduct is directed with particularity at the person who is killed" for a third-degree -- also known as "depraved-mind murder -- conviction to stand.
The evidence in Noor's case, the court ruled, was "insufficient to sustain his conviction ... for depraved-mind murder."

Noor was sentenced in June 2019 to 12 years in prison. Second-degree manslaughter is punishable by up to 10 years in prison.

A memorial service for Justine Ruszczyk was held at Lake Harriet in Minneapolis in 2017.

The 33-year-old Somali American was convicted in April of that year on charges of third-degree murder and manslaughter in the 2017 death of Ruszczyk, who had relocated from her native Australia to Minneapolis to live with her fianc.

Hennepin County Attorney Michael Freeman, in a statement, said his office was disappointed with the decision. He called Noor's second-degree murder conviction "just" and said, "we will seek the maximum sentence possible."

Don Damond, Ruszczyk's former fianc, said in a statement that he and his family were "deeply saddened" by the decision to overturn a conviction "in the needless and reckless murder of Justine."
"In many ways, this has felt like a double blow against justice," he said.

"My hope and work since Justine's death has been to try to prevent a further loss of life at the hands of stressed and inadequately trained police officers. The Minneapolis Police Department has not made any meaningful progress towards transformation. And now Noor is not being held accountable for killing my (fiance) ... It truly feels like there has been no justice for Justine."
Noor testified at trial that he feared for partner's life

At Noor's trial, his lawyer argued that a "perfect storm" of events led to him opening fire on Ruszczyk the night of July 15, 2017, when she called 911 to report a possible assault in progress in an alley behind her Minneapolis home.

Noor testified that he feared for his partner's life as Ruszczyk approached their squad car in the dark, empty alley. But Hennepin County prosecutors said Noor overreacted and failed to properly assess the situation before firing a gunshot into Ruszczyk's abdomen.

Noor apologized to Ruszczyk's family and said he will think of her every day.

Prosecutors said Noor was sitting in the passenger seat, pulled out his gun and shot across the vehicle to hit Ruszczyk, who was outside the driver's side door.

Noor testified that his partner's terrified expression and the sight of Ruszczyk with her hand raised jolted him into action. Although he did not see a gun in the woman's hand, he feared his partner might be shot as she began to raise her hand, he said.

Ruszczyk's death drew widespread attention, in the United States and in her native Australia.

The average person doesn't need a COVID-19 booster yet, an international group of scientists including two top U.S. regulators wrote Monday in a scientific journal.

The experts reviewed studies of the vaccines' performance and concluded the shots are working well despite the extra-contagious delta variant, especially against severe disease.

"Even in populations with fairly high vaccination rates, the unvaccinated are still the major drivers of transmission" at this stage of the pandemic, they concluded.

The opinion piece, published in The Lancet, illustrates the intense scientific debate about who needs booster doses and when, a decision the U.S. and other countries are grappling with.

The White House has announced plans to roll out boosters this month

After revelations of political meddling in the Trump administration's coronavirus response, President Joe Biden has promised to "follow the science." But the review raises the question of whether his administration is moving faster than the experts.

The authors include two leading vaccine reviewers at the Food and Drug Administration, Drs. Phil Krause and Marion Gruber, who recently announced they will be stepping down this fall. Among the other 16 authors are leading vaccine researchers in the U.S., Britain, France, South Africa and India, plus scientists with the World Health Organization, which already has urged a moratorium on boosters until poor countries are better vaccinated.

In the U.S., the White House has begun planning for boosters later this month, if both the FDA and Centers for Disease Control and Prevention agree. Advisers to the FDA will weigh evidence about an extra Pfizer shot Friday at a key public meeting.

Georgetown University's Larry Gostin said the paper "throws gasoline on the fire" in the debate about whether most Americans truly need boosters and whether the White House got ahead of scientists.
"It's always a fundamental error of process to make a scientific announcement before the public health agencies have acted and that's exactly what happened here," said Gostin, a lawyer and public health specialist.

The FDA did not respond to requests for comment Monday morning.

The debate highlights questions about whether vaccine protection is waning

The U.S. already offers an extra dose of the Pfizer or Moderna vaccines to people with severely weakened immune systems.

For the general population, the debate is boiling down to whether boosters should be given even though the vaccines are still offering high protection against severe disease possibly in hopes of blocking milder "breakthrough" infections among the fully vaccinated.

Last week, CDC Director Dr. Rochelle Walensky said new data showed that as delta surged, the unvaccinated were 4.5 times more likely than the fully vaccinated to get infected, over 10 times more likely to be hospitalized and 11 times more likely to die. Still, government scientists are also weighing hints that protection is waning among older adults who were vaccinated early last winter.

The writers of Monday's commentary reported reviewing worldwide studies since delta began surging, mostly of U.S. and European vaccines. The team concluded "none of these studies has provided credible evidence of substantially declining protection against severe disease."

Because the body builds layers of immunity, gradual drops in antibody levels don't necessarily mean overall effectiveness is dropping "and reductions in vaccine efficacy against mild disease do not necessarily predict reductions in the (typically higher) efficacy against severe disease," they wrote.

The more the virus spreads, the more opportunity it has to evolve into strains that could escape current vaccines. The Lancet reviewers suggest there could be bigger gains from creating booster doses that better match circulating variants, much like flu vaccine is regularly updated, than from just giving extra doses of the original vaccine.

"There is an opportunity now to study variant-based boosters before there is widespread need for them," the scientists wrote.

Anyone who thinks 30 Whataburgers throughout KCMO and surrounding suburbs is too much is ignorant. It's a massive area. Surely includes Lenexa, Olathe, Lee's Summit, Independence, like there's so much space and a ton of areas, not to mention at least 3-4 will go in the downtown area/surrounding area alone.

30 is a great number. Not too much, but not too little that you'll be stuck driving a long way for one.

The misleading topic title is likely contributing to the confusion.
