Could be pretty generalized - "Drug tests are only permitted if they detect (a) current levels of intoxication, or (b) use within a prior period roughly consistent with the duration for which the drug is expected to impair". Obviously with better legalese than mine. And also likely would need to be some concentration in blood / breath / etc used as a proxy, much like how breath / blood alcohol content is used as a proxy for intoxication in drink drive.
