Because I've learned over the years to check and it's saved my ass a few times.

Damn that sucks, glad you're okay. Hope you get well soon. I went from never being in an accident to being rear ended twice in 2015. I also actually prevented an accident today like maybe an hour or so ago. The guy next to me started running a red light thinking it was our light that turned green, and then I honked and him and he stopped and went back before he hit someone. But yeah, car accidents are a bitch

I didn't like my car... but I did just finish paying it off literally 2 months ago, so I'm pretty annoyed.

My mom's set to get a ton of money in the next few months because of this accident she got into last january.

Nope. No-fault, despite it's name, doesn't actually mean no one is at fault. It just means that you deal with your own insurance rather than the other person's insurance, regardless of whose fault it was.

Since I was not at fault, I don't need to pay anything and my rates won't go up.

I've never been in an accident, but when there is one, how do they prove who was at fault unless someone has a dashcam or there is a witness nearby? Do they just assume that where the person hit you is indication enough?

In that situation you just have to hope people are honest. Otherwise they're often forced to call it "50-50" and just say both people are at fault (and usually insurance penalizes you less if the cops deem both people to be at fault rather than just you. For example, my insurance uses a demerit point system. An at fault accident is 6 points against you, a 50-50 accident is only 3).

Often the location where you got hit isn't good enough (other than rear ending someone). Take my incident for example. If he said I ran the red light and I said he ran the red light... the cops would have literally no way to tell who was telling the truth.

I'm annoyed that despite like 6 other vehicles being around at the time of the incident, no one stopped to offer to be a witness. But the guy who hit me fessed up to the cops, so looks like it should be fine.

Is your car totaled? Usually the tow truck driver (if you can't drive it away) can tell just by looking at it. If there's any chassis damage it's most likely done.

Here in the US you get their insurance info and call your company telling them what happened. Multiple times you will have to speak answering simple questions like what time of day it was, the condition of the road, how many lanes were there, etc. I've had two major accidents and one minor accident in the last two years and my parents just had a major one last week. All three major accidents the car was done for. It sucks but we got 7K - 8K which went towards a new car.

@PK_Spam - How do you go about suing someone over an accident? All the ones I mentioned the other party was clearly at fault and insurance saw it that way in the end. Could we have been jerks and gotten more out of it?

It depends on the crash but in The Netherlands an insurer investigates the damage of both vehicles and basically concludes what happened. We also have reports that we need to fill in that outline our point of view, which need to be signed by both drivers.

Unless it's a pile-up then everybody basically goes "fuck it" and pay themselves. I've been in one...... Good times.

I don't have you blocked (I don't block anyone), it's a loaded question that you already know the answer to. Nothing good can come from my answering of it.

If I say I gunned it immediately, we automatically start the victim blaming portion of this and the whole "oh, it's clearly at least partially your fault. You could have avoided it if you did x, y, and z."

If I say I cautiously checked that traffic was clear, and everything was good and this guy just came out of nowhere, that's very clearly a lie, as how did I get in the accident then?

But to answer your question, because fuck it, why not, yes, I went immediately when the light turned green. Normally I'm more cautious than that and have managed to go a decade without being in an accident at all because of it. However, no one makes the 100% correct call every single time they do something, and all it takes is one decision made in a fraction of a second to cause something like this.

In the end, the other driver ran the red light and hit me. This is not my fault, and any changes that I could have done to prevent this are merely niceties on my end and not requirements. If he followed the law, I would not have been hit.

It's not a loaded question and if I knew the answer I wouldn't have asked. I'm also not looking to victim blame.

I'm well aware that even if you wait a second or two before going you can still get hit, but it's a lot less likely.

Nobody is perfect; I have on occasion started driving on green without looking.

Well, I can't speak for other PotDers... but the other driver admitted fault and the cops took down his statement and mine, which matched. So I'm definitely not at fault.

The dealer I bought my car from just sent me a note for a "invitation only private sale" and said they're looking for trade-ins like my 2013 Ford Fiesta.
