It's super confusing...I dont know who's a Marvel character, who's DC...who played a genie in the 90s and if it was related to marvel or DC

Just stop with this Marvel/ShaKazaam crap for awhile until all of this makes sense!

Two individuals can have the same name without it being confusing.

There is Mar-Vell, the alien who was Captain Marvel and then passed the title to Carol Danvers, Ms. Marvel at the time.

There also is Billy Bateson (or sometimes a group of kid) who turns into Captain Marvel after shouting Shazam!

Same name, different characters that could not be more different.

Shazam literally is not called Captain Marvel anymore.

There is no confusion because if you know he was called Captain Marvel you know enough about the character to not confuse him with the other one.

They do when trademark law gets involved, and one company literally changes the name of their character to not be what it used to be to compensate.

It's not like it matters, though. DC reboots its entire continuity so often nearly every single facet of "Shazam"'s personality and backstory is different from what it used to be anyway, so changing his name is about the least significant thing they've completely altered.

I have little sympathy for DC in this situation, though. The only reason they own the former Captain Marvel/current Shazam as a character in the first place is because they sued the company that actually created him out of business and then bought up their assets out of bankruptcy, and then they ignored the character for years because they didn't really give a shit about him, which is why they let trademark lapse. And then, after it became an issue, they still spent years whining about how unfair it was and throwing tantrums rather than just solving the problem the way they ultimately did anyway, by just changing the character's name (to something most people associate with the character more than his actual former name anyway).

First they tried the he's a rip off of Superman route that failed but then they went with some of his stories are rip offs of some of Supermans and for whatever reason that won.

Thing with the copyright with marvel though is dc is still allowed to call Shazam captain marvel they just can't use the name for promotional reasons I believe. Like the comic itself can't be called captain marvel.

Nope. It is completely illegal for DC to use the name Captain Marvel. Completely, absolutely and positively illegal.

Actually, after the lawsuit, they were able to still call him Captain Marvel, but the comic had to be called Shazam. I don't know if that has changed within the last however many years, but he was right about that.

He's been called it as recently as the new 52 I believe. I think dc is just shying away from calling him that more and more. Makes me wonder what they will call the others if they bring them back though, Mary marvel and captain marvel junior

They sued on the grounds that the character was a copy of Superman. When the bottom fell out of the superhero market in the 1950s, it left the company on financially unstable ground they never really managed to recover from.

They can use the name.

It's a trademark issue, not a copyright issue. DC holds copyright on the character of Captain Marvel, which means that the name and likeness can be used in comics and other media. But Marvel owns the trademark on the name Captain Marvel (which they acquired in the late 1960s, before DC acquired the rights to the Shazam/Captain Marvel character), which means DC cannot use the name for marketing or brand identity purposes.

In other words, DC can have a comic with a character called Captain Marvel in it, but they can't actually call the comic Captain Marvel (this is why, in the 90s, they had a comic book called "The Power of Shazam"). They could have Captain Marvel as a character in a movie, but they wouldn't be able to call the movie Captain Marvel (this is why the upcoming movie is just called Shazam).

DC basically got sick and tired of dealing with this years ago, and because it makes everything more confusing, they just decided to officially change the name of the character to Shazam after the New 52 reboot. It also resulted in them dropping the names of Mary Marvel and Captain Marvel Jr because they no longer make any sense.

Realistically, though, they're probably better off not having characters with the same name as their rival company anyway, because most of the audience is going to assume that they're Marvel universe characters, and get confused that they're not crossing over with the Avengers.

As I said too I understand the initial Superman rip odd lawsuit failed but they won one based on some stories being too similar

Really big dick move by DC as I understand they where just mad cause captain marvel/Shazam outsold Superman comics for a little while.

And now that they have him they barely use him and have made him out to be a Superman fan boy when they do. Also even though he has beat supes, supes has beaten him more and on paper Shazam should be able to beat him the majority not the time.

DC got salty as fuck.
