Only a moron would literally defend transporting 3 pounds of weed to the other side of the county in a state where weed is illegal.

Why wouldn't you defend doing something harmless?

Because its against the law in Mississippi. Want to smoke weed? Move to a state where its legal. Better yet, stay in Oregon, which the dumb ass in the news story failed to do.

Upholding the law for the sake of upholding the law is a dangerous mentality. Would you have reported runaway slaves?

If you want it changed call your senators and tell them you're displeased and rally others to do so as well. Complaining on a forum how unfair the law is won't help shit.

But why do that when you can effectively have the same thing with less effort if cops simply don't enforce it?

There's tons of places with sodomy laws on the books - they're literally never enforced, and aren't worth the money it'd take to repeal those laws.

The laws themselves aren't the problem, it's the enforcement thereof. Here in Canadaland we finally legalized, but for the past few years cops just never bothered enforcing weed laws. Everyone was pretty happy with that. We're still happy, and now the country has tax dollars. But if we didn't legalize, we'd have been fine so long as the cops didn't enforce those ass-backwards stone age laws.

I mean he was on a long ass road trip on his way back to Oregon from Ohio. He claims he smokes the weed medically for chronic knee pain from college basketball. fair enough.

Now was 3(2.8) pounds a bit excessive? probably... but he is Jamaican so who knows?

But was he really trafficking the stuff?
I mean, okay, if the definition for trafficking is just "Large amount over state lines" then yeah, i guess he was.
But does intent to sell come with trafficking?

I mean you could argue "NOBODY SMOKES 3 POUNDS HE WAS SELLING THAT SHIT" until you're blue in the face. The other side will just say "prove it."

Just like in this article https://reason.com/blog/2018/10/18/jamaican-musician-sentenced-8-years-weed

Prosecutors, on the other hand, decided to charge him with drug trafficking. But they didn't have a whole of evidence to back that up, aside from the fact that 2.8 pounds of marijuana is a lot for one person. The Ledger explains that Mangino "found no large sums of money, drug paraphernalia or weight measuring scale to substantiate the trafficking charge." According to Mississippi Today, an assistant district attorney argued that references to "music" in text messages found on Beadle's phone were actually code for the marijuana he was selling. However, those texts were not admitted as evidence.

So was carrying all the weed dumb and illegal? Yes

Was he trafficking the stuff? if the definition for trafficking is just "Large amount over state lines" then yeah, i guess he was.

Did he intend to sell? Who the hell knows?

Is the law dumb or not dumb? Doesn't really matter.

Was the sentence harsh? Probably. At least based on the evidence.

And here in Canadaland, you can still get in trouble for having too much at once in public. We're limited to 30 grams in public, this dude had 1360 grams. That's about 45 times our limit.

I've seen this come up on Live PD a few times, unfortunately. If you enter a jurisdiction that does not recognize the legality of marijuana of where you bought it, you are open to prosecution. It sucks but if you don't allow this then you're getting into the whole "federal vs. states rights" thing.

I'm wondering if it's as bad as the activists portray, though. To me it sounds more like everyone along the chain was just following the letter of the law and probably recognized he didn't do anything he thought was wrong but had to carry out the sentence per legal guidelines.

Fair, the states ignoring federal law doesn't allow you to break the federal law.

If you want pot legal change the actual law don't ignore it. Same story with illegal immigrants and sanctuary cities ignoring the law.
