It's no different than selling his car for ten dollars under the hypothetical that he'll run her down in the street. Like, it sucks she's been abused, but that's just her being petty. If he's such a danger that he may kill her, then he'll just get another gun and do it. There's nothing of what she's done that can reasonably be called self-protection. Hopefully she fully leaves him and goes somewhere out of his reach if he's that much of a danger.

Under the law, the cops can confiscate his guns due to his domestic violence.

Yeah, reading it, seems like that officer has issues. I would prefer if they didn't charge her and just explained why she can't do what she did, but I'm also fine with it ultimately being up to law enforcement to confiscate the weapons. Probably could allow for less discretion though

I read this story yesterday. Her husband rammed his car into hers and ran her off the road after a divorce court appointment. I would be terrified for my life too. I would rather have risked jail to turn in his weapons than wait for him to try and finish the job. They also have children together and she must have been worried for their safety as well. Cops have the power to confiscate the weapons, true. But they dont always do so in time.

The report says they are estranged. It was not her apartment. She had no right to enter it. The guy is a piece of shit but laws don't suddenly stop applying because you're dealing with a piece of shit. I don't think she should go to prison or anything but to pretend she didn't commit a crime when she absolutely did is just absurd.

That's the law. Breaking and entering and stealing items isn't her role to play. She could've notified the police, told them about the weapons, and got a restraining order. Not enough? Move in with a friend or go elsewhere if you feel your life is in danger.

She did commit a crime, the issue I have with your take is that you framed it as him "being an asshole" as though a totally reasonable fear for her life is nothing more than an annoyance or inconvenience to her. then the cops do nothing about the guns because of the 2nd amendment, he gets the restraining order and goes to find her. he doesn't seem like the most stable person and people in distressing situations like she is will do anything they can to save themselves. Sad part is some people non-ironically have this mentality.

Self-preservation isn't inherently alt-right. The dude already used his vehicle in attempts to intimidate/out right kill her, so he's already shown murderous intent. Not to be that guy, but even without a gun, car, or any tool whatsoever, if he wants to kill her, he's going to find a way. Unless a cop is with her 24/7, which I doubt they'd do for her.

yes i get where she is coming from and yes she still broke the law.

the guy needs to be evaluated and charged accordingly if she feels things are getting that bad cause if she feels he will kill her, taking away his guns isnt going to stop him. couples have died from beatings, strangulation or stabbings (especially in heat of the moments situations) just as much from firearms and if its a man giving violence to a women then its not going to be immensely difficult to do so.

if they're legally married, the guns would fall under martial property laws

ie they are hers to surrender

i see no reason to ignore the legal technicalities of one set of property laws just to emphasize the legal technicalities of another
