Sorry you just assume major companies just are out to get you. Smells a bit like paranoia to me. If you think everyone is out to get you in your personal interactions in your every day life then I would think that speaks to your issues, not to my being naive.

A suggestion just occurred to me. Is there a local "SOS" service, through a local radio station or newspaper or something? Some places have one of those that play hardball with the company who wronged a customer such as yourself - i.e. "Pay us $257 in overages that we never let you know about" or "You charged me $122 for a plane ticket that I canceled instead of the $15 cancellation fee."

Do you think somebody who has a lot of experience navigating these situations can help?

I signed up for Financial Aid

They said I qualified and I was taken care of

I still received notifications for the bill

I called them again

they said I'm still taken care of

fast forward to today

got a bill FROM ANOTHER COLLECTION AGENCY for the bill

it was never taken care of

Had an allergic reaction (and we don't know what to) during a 1 week period where her health insurance lapsed between jobs. Applied for financial aid and was told everything was fine. Ended up getting a bill of like $500 and paid it off.

Fast forward a few months and the hospital is chasing her up for an extra $500 which was for the doctors time or some shit despite being told everything was fine and taken care of whenever she spoke to their finance people. Even today now like 15 months onwards she gets collections agencies chasing her up even though every time she talks to the hospital they say it was taken care of or they have paperwork issues or something

Worst fucking part is it was for an allergic reaction that had completely gone away by the time the doctor got to see her. He spoke to her for less than 3 minutes and only recommended carrying an EpiPen in case it happened again. So they effectively charged her $1000 with financial aid to sit and wait 2 hours and be told something that was common sense. She even told them when we got there that if they didn't have some sort of financial aid program to take care of it, we didn't want to wait

Something I'm not clear on: is the company supposed to send you the documents you requested as part of discovery, or are they allowed to just bring them to court? It seems like the kind of thing they'd need to present to you.

they specifically told me they would send me something once they receive it from them

so yea, either this means they don't have the stuff, they don't care that much like SantaRPG has been saying, or they're simply gonna bring it to court

but that last part seems weird, it seems like even the court is expecting it before them

there are no penalties other than eventually dismissal of the action, either with or without prejudice. dismissed with prejudice means they can't come back and try to revive the lawsuit. without prejudice means the judge is giving them another chance to come back and revive the case but until they do the case is thrown out.

there's usually no penalty for filing a lawsuit for "wasting time." after enough bs cases, a person or entity can eventually be found to be a vexatious litigant, but this is a pretty high bar (and might not apply to TX). you might be able to request the judge issue monetary sanctions against the company if they refuse to follow court orders or seem to be acting in bad faith, but again that's a long shot.

all of the above is my understanding from California civil litigation. there might and probably will be differences in your situation.

Again, I'm not a lawyer, but I think they haven't provided the documents in a timely manner. If I'm reading this correctly, they had 30 days from your discovery request to comply. They could theoretically request a continuance, but I suppose it would be up to the judge to decide if that happens. Texas civil rules of discovery below:

but the most likely scenario is they did this to maybe 200 people and 180 people didn't respond like you did and they're just going to take the money from them instead since it's literally free money backed by the courts for them. You're almost certainly not worth the labor.

For the record guys, court fees are a thing

the case infront of mine the woman instantly keeled over and she just agreed to whatever. court fees were like 200 bucks

but anyways, something DID happen

That woman wanted to speak to me and me alone. I was the only one. She wanted to settle. Unfortunately we didn't get much time to talk because the judge arrived and we had to go back to the courtroom, but it gave me a glimmer of hope

lots of no shows. I would never dream of not showing up man.

yall know everything about me by this point, I wanted to know if they had the right to sue, informed them I haven't been contacted, and they had the correct paper work

she confirmed my address, my phone number, she had the paper work. They determined that credit cards have an agreement on usage, not a signed contract so they didn't need a paper saying that.

while they could not confirm I ACTUALLY received anything, she had every copy of every statement ever issued monthly to me with my correct information on it

Judge asked me if I ever had this credit card. I said yes. Obviously I can't lie, I wasn't thinking about lying, I could never lie to the court.

Now heres the kicker

if yall recall, I had help from a lady at a desk a few months ago. Shes the one that told me about the Motion of Discovery. She was the judge's right hand person in court today. I brought this up, I put forth a motion and then I never heard anything afterwards. The judge checked her files and she found it, she approved it. They never complied.

Judge said, while saying they were gonna be reprimanded for it, it has no real bearing on anything. Because the woman brought the proof they owned the debt with her today. Thats all the judge wanted to see

btw desk lady pissed me off. She faxed and emailed the plaintiff this motion for discovery. When the judge asked if she did this, she was like I HAVE NO RECOLLECTION. Luckily I had the copy she gave me confirming she did that. I felt like Phoenix Wright. But also the judge found the paper work immediately anyways, for better or for worse I had no impact. I wonder what would have happened if there was no proof she did not do this. But again, Judge didn't really are about this anyways because lawyer lady brought the paper work and presented it to me

but yea guys, it was a valiant effort, there was some hope, but its me, guys

The only good thing is that the judge offered one last chance for a settlement. "I will allow you one more chance right now to talk it over"

So I did settle. 700 dollars and waive court fees

I'm really sad but I guess this is all my fault
