Any of you heard about this story? Any of you think the prisoner has a good point?

To be fair its not a bad argument to make.

Its still open to getting shot down but I dont dismiss his attempt out of hand. I think its a reasonable request.

If he's legally dead, then surely anyone could now shoot him in the head and face no charges for it.

I heard of it. The States argument against it was that a coroner never certified him as dead and thats what is legally required by law to be recognized as dead. If only he had a certified coroner on hand when his heart stopped, then maybe hed be free...

Isnt there a time period that must pass in order for them to legally call it?

No because he only clinically died momentarily. Meaning that his heart/breathing stopped momentarily.

He did not undergo biological death and therefore never died in the legal sense.

There was a time when people who survive their execution was as sign from god that they deserved to live...

Shortly afterwards the law was changed to make sure people are definitely dead before they stop executing them.

It is an absolutely awful argument to make. It should automatically be dismissed.

This is why some criminals get multiple life sentences, or sentences like "Life plus 40 years". We've got to account for unexpected resurrections!

Actually, it doesn't matter at all - in a legal sense, "life" doesn't literally mean life, it refers to a specific period of time which is considered sufficient to keep a prison in prison for the rest of their life. This matters for parole reasons (where you're only eligible for parole after serving 1/12th of your total sentence, so "life" needs a specific numerical value unless your sentence is "life with no possibility of parole").

That's also why sentences like "life plus 40 years" exist - it's adding the 40 years to the number value of "life" to get a longer period of time before parole eligibility kick in.

I think "life" differs based on where you are, but the average time is usually somewhere around 70 years or so.

What a dumb ass argument. Being rescutated against his will is unrelated to his sentence and that needs to be taken up separately.

Also lol professor primus.

And then slowly most of the civilized world just did away with executions altogether.
