A good point was raised by the ACLU about the murder 3 charge, though. Precedent in Minnesota law tends toward murder 3 not being supported if only one person is in danger.

It's a pretty shit situation all around.

first thing i thought when i saw the upgraded charges was that they're going to have a hell of a time proving it. 3rd degree murder is essentially accidental manslaughter, 2nd degree requires malice.

i remember reading that the guys might have known each other, something about working in the same club for about a year. maybe there's history there.

That could be their angle, I have seen a lot of that stuff about precedent for 3rd degree being talked about as well.

I admit I am not qualified to comment on the intricacies of the law in that regard.

Wasn't he set for 20-30 years with 3rd degree? Whilst 2nd degree would bump it to around 40 years if it actually works, which is far less likely than the almost guaranteed 3rd degree charges.

The judge will still give the jury instructions that they can find him guilty of manslaughter as well as murder. Just like they did with Zimmerman.

This whole "This just makes it easier to find him not guilty because he can no longer be accused of mansalughter!" stuff is claptrap.

The only difference this makes is sentence and the barganing position of plea deals. Which in both cases, raising the charge is a good thing for people who want justice.

That's not how the justice system works.

This isn't fucking Phoenix Wright.

Do you even know how the justice system works? Going for 1st degree murder would require the prosecution to prove it beyond reasonable doubt. It is much much less likely to be proven guilty.

The difference between second and third degree murder is its effectively saying that this was the result of an accident if they go with third degree.

Im expecting the defense to either get everyone to clam up or else insist that this was a valid tactic included in the departments training manual.

I had a similar issue with the Casey Anthony case. I felt like they were trying to go for the big money when they didn't have enough evidence to prove it, despite the existence of enough evidence to prove a lesser charge.
