Houston family sues Arbys after 63-year-old woman beat her hands bloody before dying in restaurant freezer

"63-year-old Nguyet Le was temporarily working at a New Iberia, Louisiana Arbys when she died. Her son found her body in the restaurants freezer.

The children of a Houston woman who died in an Arbys walk-in freezer earlier this month are suing the fast food restaurant and franchise owner, alleging her death could have been prevented.

Nguyet Le, 63, died May 11 at the Arbys in New Iberia, Louisiana, where she was on a temporary general manager assignment. The duty was supposed to last four weeks but was extended by two weeks, according to the lawsuit filed in Harris County.

Les son, who worked with her, found her dead in the freezer.

Ms. Le fought for her life. She had a panic moment, said Houston attorney Paul Skrabanek, who represents the family. She beat so hard that her hands [were] bloodied and there was blood on the door and ultimately fell into the fetal position on the floor face first. And the cause of death is hypothermia.

According to the wrongful death lawsuit alleging negligence and gross negligence, the freezer was typically kept at 10 degrees below zero if not colder. Also, the freezer latch had been reportedly broken since August 2022 and employees say they have had to use a screwdriver to open and close the door, adding that a box of oil was used to keep the freezer door open.

The freezer door has been broken for months. Theyve known about it, workers who have complained and everyone knows it, there was multiple work orders put in, a former employee told a Louisiana television station.

They didnt want to be identified but shared photos from inside the freezer.
This happened to the lady because of them... if they wouldve got the freezer door fixed this wouldnt be an issue, the former employee said.

Skrabanek said the door got fixed a day or two after the death.

Weve hired a pathologist to help us understand what it is like to freeze to death. And whats been relayed to me is that its similar to burning to death. Its panic, sheer panic. Its curling up, not being able to move at some point, Skrabanek said. Hopefully the silver lining [hopefully] what comes out of this is that the Le legacy is that things get safer in restaurants like this.

The family is seeking an unspecified amount in damages.
Arbys wrote in a statement that the company is aware of the incident and fully cooperating with local authorities investigating."

I'd have to imagine there is a way to open from the inside typically. If the door has been broken for a long time like the article indicates, I'd say this should be an easy win for the family.

But also hopefully there's a culture change with both companies(at least Arbys) actually prioritizing maintenance and safety. . .
and also with workers telling companies to fuck off when asked to do things that are unsafe.

I'm absolutely not victim blaming, she probably wasn't in a position to just say "the freezer is out of order" (though that type of issue, absolute it is) without risking her job and next rent check or meal. . .
*however* blue collar workers need to come together on this to build a safety culture as robust as NASA's or at least the average civil engineer's. This is a going forward statement, not a misdirection of fault.

If the door got fixed a day or two afterward then it clearly wasn't an issue of them being unable to get a repair person out to fix the door. It sounds like they just didn't want to spend the money.

That's why they need to be made to pay out a large settlement for this. The only way you get a lot of employers not to ignore workplace hazards like this is to make it more costly to ignore them than it is to pay to have them fixed.

Every worker should just at a minimum constantly start reporting companies and publicly shaming them. Film as much as possible, sue as much as possible, etc.

I'm sad to say I fell for this when I was younger too

They fired the manager, gave me all the responsbilities but not a payrise. Got a fancy title and worked my ass off to hit every fucking KPI was I given. I was like "Surely they recongize my hard work and reward me!"

They wouldn't give a shit if I burned to death in front of them. Meanwhile random useless friends of people in charge got given cushy jobs for no reason.

Someone I knew was getting paid only a little bit less than I was and spent 90% of their day just online shopping and farting around because they had no real work or responsibilites.

The last straw was when they hired guys who were friends of the boss to the provide drivers for Van Fleet including people who had been fired before for violence.

It was the first job I ever quit. A year or two before I would have been like "I'm no quitter! I'll prove myself!" like an idiot.

yeah if I call a company to have something like my walk-in freezer door fixed they usually have someone out within 3-5 hours at most. If theyre really busy it might be the afternoon or next day.

This right here is what will likely lead to the family winning. I've worked in the restaurant industry for years now, as well as fast food, and the places I worked at took this quite seriously and there were always measures to ensure you weren't accidentally locked in.

If they can prove they knew the freezer was broken and just decided not to fix it, then ya, they're definitely responsible.

Poor woman, what a terrible and horrifying way to go.

Totally. I remember as a kid, my grandpa owned a bar, and being good little bar owning shit head kids, we ran around and played in the place. I will never forget one time going into the walk in and my brother closed it, and just being in there for.... hell, it was probably seconds if not a minute or 2, but it felt like an eternity, before he opened the door again. I don't want to think about what it'd be like being in there long enough for you to actually die.

There was this huge butcher shop that had like a whole freezer warehouse you could go into and buy meat straight off the hook when I was growing up. Sometimes in the summer I'd try to go there just to walk around in the freezer. But man after like 10 minutes in there, that shit starts getting uncomfortable. Especially if you're wearing clothes intended for June.

Settling does not concede fault here in America. That will be part of their settlement. They won't "get out of it" unless it is determined to be a "thing" across all Arby's, otherwise this will just be viewed as "business as usual" and MAYBE a newsletter will get passed around for employees to use a buddy system of going into the freezer.

From experience, I could literally go on about the type of stuff that should have been fixed, but either never got fixed or was temporary and broke again and again. Doesn't matter if it's a franchise or local.
