Fair, because people are so thirsty to get their dicks wet that they can't be bothered to do a little fact-check beforehand. If you can't do that to save yourself from the potential trouble that will happen if they happened to be underaged then you deserved to get into all that trouble.
People like to spew nonsense on "Oh she lied, she should be the one who should go to jail." then go ahead and put her in jail as well. Just because she committed a crime doesn't mean that the guy didn't. _
