My understanding is that the rule was never updated when gay marriage was legalized - before that if you were in a same sex relationship and wanted your spouse on your insurance AT ALL you were SOL no matter what. And they did update the rules around married gay couples pretty quickly from what I remember. But the sequence of "it was afforded to straight couples, didn't get extended to gay couples, then when they did change the rules it was abandoned entirely" felt to most of us like it was intentionally leaving us out. But given that they have the excuse of "they ended the program for everyone" they can fall back on something where I'm not sure we would have enough of a case to prove anything. And the wording of my post probably led you to believe I had something more concrete than that, so I'm sorry if I was misleading. I wouldn't be surprised if someone tried and they ultimately decided it wasn't worth pursuing.
