The content locked behind amiibo is absolutely not dlc worth content. For 40 bucks you have a complete game.
A picture gallery and an "harder than hard mode, but still dull mode" are absolutely not a reason to buy amiibo. That's the fail of your "logic", as you seem to take the problem reversed.
Those are bonuses for having bought plastic toys. They are more or less cool bonuses, but absolutely not something you would pay for, nor something lacking to the game if you want to have a "complete experience" (whatever that would mean).

Also, you're not fair about am2r.
Nintendo let the dev finish the game (it was in development since 8 years, and was probably the most famous fan game ever), they let him release it, then started to launch dmca to the sites monetizing the host of the game. It took more than a week before they contacted the dev. Just a fragment of eternity on internet: the game is now available for anyone who can use google.
I think that nintendo could have managed this in a better way, but they just couldn't let people make money with a brand they own while they were founding the development of a similar game.
The situation is not that bad. We have a great fan game for free, and a commercial other great game.
Nothing to complain, really.
