Justice was invented so that feuding clans wouldn't endlessly kill each other, reducing the total pool of soldiers during times of war.

Since that's no longer a risk, justice is nothing but a system of control

Violent/sex offenders (unjustified) - death
Violent offenders (justified, but not enough to be found not guilty) - prison
Drug offences (etc) - rehab at an isolated location (not-evil work camp)
Minor offences - three strikes

Take the 3 strike system for example. It unfairly punishes people who are more likely to commit multiple habitual crimes, and unfairly doesn't punish more serious crimes of passion that are less likely to occur. This is further amplified by how most (not all) habitual crimes are against the state, not against the peers... there is no risk of retaliation and no violation of social contract.

If that's what you're getting at, then you've rather alarmistly said that the justice system is nothing but that. Which is silly and wrong.

And even if I grant that this does happen, within some limited scope, among places mostly if not entirely in the United States (and by no means the entire US), it doesn't represent The (capital T) Justice System in principle, and broadly speaking not entirely (I'd argue not mostly) in practice.
