So there's a significant concern that I believe folks are missing.

Merchant's examination, especially when she's referring to what Bradley "told [her]" and their text message exchanges, raises the potential that she should be testifying as a witness instead.

Really toeing some ethical lines with this.

Reading the transcript I thought it was really odd. The other side kept objecting on the basis of foundation because the examining attorney kept saying variations of do you remember when you told me XYZ? which apparently hadnt been introduced into the trial before.

Merchant is a lawyer representing Michael Roman, one of the Georgia RICO defendants. They're the ones who started the motions about Fani Willis and Nathan Wade having an improper relationship and trying to get them disqualified. Bradley is Nathan Wade's divorce lawyer.

Saw someone mention exactly that in that reddit link mystic posted. I aint no big city fancy lawyer, just a simply hyper-chicken, but yeah that seems shady.

This Bradley thing is just bizarre, because
1) hes supposed to be one of the Defenses two star witnesses, but
2) he desperately tried to avoid giving any testimony of note, and what testimony he did give was beneficial to the State, but
3) the state absolutely demolished him anyways, and revealed that he was wildly misleading about his inability to testify to certain matters because of privilege, but
4) the defense has fairly successfully (in my view) undercut his current testimony explaining away his pro-defense text messages, but
5) now every single party has destroyed this witness, who cant possibility have any credibility with the judge
The defense needs the judge to credit Bradleys pre-trial text message as the truth, and then discredit his testimony trying to explain those messages away. But because Bradley has been so thoroughly discredited as a witness, I suspect the judge might be inclined to simply ignore everything he has ever said, which ultimately hurts the defense position.

The reason they're not doing that is presumably because if they do then they're saying "you're not allowed to use that," which - while rendering it inadmissible in the court and thus technically solving the issue - still leaves the notion out there for people to disingenuously use to taint public opinion afterwards. Whereas the current strategy literally forces Merchant to say that these things aren't true in court.

While legally speaking the end result would be the same, there's actually far more strength in forcing your opponent to openly admit in the courtroom that they've been lying about everything, as opposed to just not letting them lie about anything.

Of course, this train of logic assumes that the usuals weren't always going to be disingenuous in their reporting no matter what happened, and the State legal team are essentially trying to play chess against people who are trying to play hopscotch, but hey ho.

In reference to the Georgia RICO case, Fani Willis started her investigation in February 2021. I think the biggest problem with the length of time for her was the large number of people involved and many of them were uncooperative targets or witnesses. Some of them being current elected officials in Georgia, even.

In the classified documents case, I can't remember when the investigation started, but Judge Cannon added months of delay in the criminal investigation phase on her own by improperly stepping in and assigning a special master. After about 3 or 4 months, the 11th circuit court of appeals ended her shenanigans. Then she got assigned to the criminal trial and who knows if that trial is actually going to start in May.
