President Donald Trump signed a proclamation Friday requiring companies to pay a $100,000 fee to obtain H-1B worker visas.

The proclamation comes as the Trump administration intensifies its crackdown on immigration, through raids and massive deportation efforts in cities nationwide.

The proclamation-signing is a win for immigration hardliners on Capitol Hill, but is likely to rankle tech executives seeking qualified workers from abroad.

The H-1B visa program, which was signed into law by then-President George H.W. Bush in 1990, enables skilled workers from overseas to temporarily work in the United States. Major tech companies have relied on approvals from the program to hire employees from abroad. Amazon was among the top beneficiaries of the program, according to U.S. Citizenship and Immigration Services data, with more than 10,000 approvals, followed by Tata Consultancy Services, with 5,500 and Microsoft and Meta, with more than 5,000 approvals each.

Trump said on Friday that tech companies would be pleased with the changes.

I think theyre going to be very happy. Everyones going to be happy, Trump said.

Aaron Reichlin-Melnick, a senior fellow at the American Immigration Council, called the move "almost certainly illegal and likely to be struck down in court," in a social media post.

Bloomberg Law first reported on Trumps plans to sign the proclamation on Friday.

Congress sets an annual cap of 65,000 new visas each fiscal year and another 20,000 for those who have earned a masters degree or higher, with additional exemptions for universities and research organizations.

During his first term, Trump sought to enact rules that would have dramatically limited the issuing of new skilled-worker visas, citing the economic downturn precipitated by the Covid-19 pandemic and an effort to preserve jobs. The rules were ultimately struck down by a federal court.

More recently, Trump defended the H-1B visa program before taking office in comments to the New York Post in December, telling the outlet, I have many H-1B visas on my properties. Ive been a believer in H-1B. I have used it many times. Its a great program."

This will absolutely shatter the healthcare industry, something like a quarter of all doctors in the US are foreign-trained. Most if not all of them would have required an H-1B at some point.

3 of my wife's immediate family (she's Canadian) work as nurses/doctors in a US border town. You're not wrong at all this will devastate hospitals. On the flipside it may help with the shortage Canada has right now by forcing them to work locally.

It depended on how big the company is, but it is around:

  • Base filing fee: $460
  • USCIS registration fee: $10
  • Anti-fraud fee: $500
  • Training fee (ACWIA): $750$1,500
  • Public Law fee (for large firms): $4,000
  • Premium processing (optional): $2,500

The H1-B visa program is problematic in some ways (i.e. it should not be used as a way to recruit entry-level talent in fields like accounting or IT which it apparently sometimes is), but $100k is too damn high

I would argue the problem is less H1B and more just the raw appeal of having the job done for pennies on the dollar offshore.

Oh crap. I just heard Trump say that tech companies are on board and they love it. On one hand, the tech sector has been laying off people so Im not really gonna feel guilty for them, specially when theyve been kissing his ass.

Dude, there is indeed a shortage of tech workers. We are not talking skilled labor that only takes 6 months to 2 years to train. The Chinese and Indians have been training specialized tech skills for many many years now. You need like 4-6 years -- almost like the number of years needed when doing a plumbing or electrician apprenticeship. There literally aren't enough Americans that are skilled specifically for the work required in certain tech fields and manufacturing sectors. The labor required needs special training, and not enough Americans are in those fields right now.

this doesn't make companies magically hire locals tho all this does is make them cut down on their work force and off load it to other countries as seen with recent lay off's happening

It can currently take months to see a specialist and he's trying to prevent more from coming in. Trump shows his amount of caring for the American people more every day..

No there isn't. It's only in a couple of areas within tech, and those are not really the ones coming on H1Bs, and there are other visas for highly specialized people.

These companies layoff tens of thousands of Americans and then immediately apply for tens of thousands of H1Bs.

For the majority, it's just a way to save money and get easy to abuse workers. Healthcare makes up only 5%, and can be focused on separately.

Tech offshoring causes more trouble than it's worth, especially for smaller guys. Many of those layoffs had almost immediate applications for H1Bs. AI is already a threat to tech workers, so there's no reason to add in a bunch of additional cheap competition anymore.

The ones who can pay (Google, Amazon, Microsoft, Tesla, etc.) will, but the smaller companies and institutions will be priced out. That actually entrenches the largest corporations and helps corporate America, not Americans.

Also, there are shortages in high-skill tech roles right now. So you have no idea what you are talking about.
Almost all of that has other visas available. Those that have legitimate need can be focused on separately.

In some of the most critical areas and it isn't just "a couple." Advanced AI, chip design, biotech, cybersecurity, etc. Basically fields where the US doesn't have enough homegrown talent right now. These sort of roles take many years of training.

That's why H1B matters and it isn't some loophole. It's literally a pillar for how US tech and research sectors actually bring in the skills they can't find enough of domestically. This closes the door on every company or organization that isn't a corporation.
I didn't say it's a loophole. It's turned into a scam because of the crazy levels of abuse.
