Babys death ruled a homicide after suffering broken neck during delivery at Georgia hospital

A medical examiner on Tuesday released the manner of death for a baby whose mother accused a Georgia hospital and others of decapitating during delivery, ruling it a homicide.

The Clayton County, Georgia Medical Examiners office said the baby died from a broken neck and the babys head was detached, according to a news release shared with CNN.

The 20-year-old mother, Jessica Ross, filed a lawsuit in August alleging the Southern Regional Medical Center attempted to conceal the manner of death of the baby, Treveon Isaiah Taylor Jr., from her and her boyfriend, Trevon Isaiah Taylor Sr., along with the whole family.

The medical examiners office said Rosss baby died from fracture-dislocation with complete transection, upper cervical (C1-C2) spine and spinal cord, due to shoulder dystocia, arrest of labor, and fetal entrapment in the birth canal, according to the news release.

The medical examiner said pregnancy-induced diabetes and premature rupture of membranes were also significant conditions contributing to Taylors death.

The medical center is in Riverdale, some 13 miles south of downtown Atlanta. The baby, who was named after his father, was delivered at full term, according to the family attorney.

Ross went into labor on July 9 and her doctor attempted to deliver the baby using various methods, including applying traction to the babys head, the lawsuit says.

During the attempted delivery, the baby did not properly descend due to shoulder dystocia, a condition when a babys shoulders become stuck in the vaginal canal, the lawsuit says.

Ross says the doctor grossly and negligently applied excessive traction on her babys head and neck, the complaint says. The doctor is also accused of failing to do a Caesarean section in a timely and proper manner, which resulted in the babys decapitation and death, according to the lawsuit. The Caesarean section was completed at about 3 a.m. on July 10, the filing said.
In a statement issued to CNN after the medical examiners announcement, a spokesperson for Southern Regional Medical Center said: Due to current litigation, we are unable to comment.

In August, after Ross filed the lawsuit, the hospital said in a statement it denies the allegations in the complaint referencing the hospital.
The familys spokesperson has said that when Ross and Taylor demanded to see and hold their baby, hospital staff told them that they were not allowed to touch or hold their child.

Our heartfelt thoughts and prayers are with the family and all those impacted by this tragic event, the medical centers statement reads. Our prayers also remain with the dedicated team of physicians, nurses and staff at Southern Regional Medical Center who cared for this patient. Our commitment is to provide compassionate, quality care to every single patient, and this loss is heartbreaking.

The workers only allowed the couple to see their dead childs body, the familys spokesperson said.

During this viewing, their baby was wrapped tightly in a blanket with his head propped on top of his body in a manner such that those viewing him could not identify that he had been decapitated, the statement said.

I have never witnessed anything like this before. No one in our office has seen anything like this. Everyone we have consulted has never seen a situation like this before, Clayton County Medical Examiners Director Brian Byars told CNN on Tuesday. I find it very unusual that the hospital didnt contact our office due to the amount of trauma that was involved in this incident.
The case is still under investigation by the Clayton County Police Department and could be referred to the District Attorneys office, the release said.
Ross and her boyfriend are expected to give a public press conference in Atlanta on Wednesday at 11 a.m.

The initial GameCube launch did not really catch my interest or make me think it was a console I should purchase. One of my good friends bought one, so we would play Smash Brothers Melee from time to time, and that was about it. I'm sure Luigi's Manison, Waverace, and Rogue Squadron were OK, but those games and the later titles released during the year didn't do anything to make me think it was time to buy the system. I was content with still playing PS1 and PS2 games at the time.

However, that mindset completely changed with Metroid Prime. It was a game I had on the radar and kept checking for updates since I've always been a Metroid fan, and it had been close to 8 years since Super Metroid. I remember reading the reviews in an EGM issue, and they said, "Get this gameeven if you have to buy a GameCube to play it." So that's what I did, and it was worth every penny.
I'm stuck in that game atm.

So, the school has several choices:

1) Have the parents take custody (they refused)

2) Send the kid home, where he might be suicidal.

3) Send him back to class, not knowing he has a weapon, endangering other students.

4) Have a school staff member watch him, not knowing he has a weapon, endangering the staff member.

https://www.cnn.com/2024/02/05/us/jennifer-crumbley-oxford-shooting-trial/index.html

Jury begins deliberations in manslaughter trial of Michigan school shooters mother Jennifer Crumbley

A jury began deliberating Monday in the manslaughter trial of Jennifer Crumbley, the mother of the teenager who killed four people at a Michigan high school in 2021, in a novel legal case that stands as a test of the limits of whos responsible for a mass shooting.

Crumbley, 45, has pleaded not guilty to four counts of involuntary manslaughter for her role in the November 30, 2021, mass shooting at Oxford High School, which left four students dead and seven others wounded.
The jury of 12, made up of six men and six women, must be unanimous to reach a verdict. Five alternates will remain sequestered in a separate room from the main panel for the duration of deliberations.

The prosecution has argued she is responsible for the deaths because she was grossly negligent in giving a gun to her son Ethan, who was 15 at the time, and failing to get him proper mental health treatment despite warning signs. Over a week of testimony, law enforcement officials, school employees, shooting victims and those who knew Jennifer Crumbley testified for the prosecution.

Its a rare case that takes some really egregious facts, Oakland County Prosecutor Karen McDonald said in closing arguments Friday. It takes the unthinkable, and she has done the unthinkable, and because of that, four kids have died.

However, the defense has argued the blame lay elsewhere: on her husband for improperly securing the firearm; on the school for failing to notify her about her sons behavioral issues; and on Ethan himself, who planned and carried out the attack on his own. Defense attorney Shannon Smith said the case was dangerous for parents everywhere.

Can every parent really be responsible for everything their children do, especially when its not foreseeable? Smith said in closing arguments.

Jennifer Crumbley took the stand in her own defense and, in a remarkable moment, expressed no regret for her actions.

Ive asked myself if I would have done anything differently, and I wouldnt have, she testified.

Closing arguments took place Friday. The judge is expected to instruct the jury on the law Monday morning and deliberations will follow.
