I'm in Florida and this stupid hurricane has given me some time to waste so I spent a few minutes actually looking into this today. ***Disclaimer -- I'm not providing legal advice, just discussing what is a hypocritical scenario described by TC -- I don't practice in MD and the following is really just a rough outline of my thoughts on this hypothetical***

TC is annoying and clearly doesn't help himself by constantly putting himself in bad situations but the issue in this case is actually pretty interesting and I think he has a decent argument. It looks like an interesting area of law that isn't really clear in MD (from what I can find after about 20mins -- did not do any case law research).

The state has charged him with several violations of Section 10-402 of what is essentially the Maryland Criminal Code. As is relevant to the set of facts TC has presented, its a felony for any person to "[w]ilfully intercept, endeavor to intercept, or procure any other person to intercept or endeavor to intercept, any wire, oral, or electronic communication;"

Although there are a few elements the only one that is really at issue is whether or not recording the phone call was an "interception" as defined in MD.

According to 10-401 (3) "Intercept" means the aural or other acquisition of the contents of any wire, electronic, or oral communication through the use of any electronic, mechanical, or other device.

Although "Aural transfer" is defined I don't think the definition applies because the definition of "interception" does not use the whole term. The other important term in the definition of "interception" is "acquisition." That is different from the term "recording" but I think the prosecutor will argue that recording is a type of acquisition and this seems like a pretty straight forward argument that I would be worried about as the defense.

I see there being two main arguments a defense atty would likely make.

(1) "intercept" is different than "record" (and so is "acquire"). Basic tenants of statutory construction requires courts to give words meaning and assume that words are chosen for a reason. The legislature chose the word intercept and not record for a reason -- then the attys argue over what the reason is. From what I found it isn't clear, and this is where both sides will win/lose the case. If this issue has come up before in MD the arguments would be about why the holdings in previous cases should or shouldn't apply. A good atty would also look at other states/fed laws if there is anything that could help but it would be purly persuasive argument not binding on the court.

(2) the second argument is more of a due process/policy argument. I think there is a decent argument that can be made about the term "intercept" being vague if it applies to recording phone conversations made between two people. As it is commonly used a conversation between two parties cannot be intercepted by one of those two parties -- interception implies a third party is accessing the conversation. If a term is found to be vague the party that is being charged with violating the law is given deference and the state would lose.

Bottom line is that TC is annoying and here always looking for attention but he may have a decent argument in this case. From a pure legal concepts perspective its kind of an interesting argument. I have a feeling there are politics involved too. I feel like the SA's office probably didn't want to bring the case but TC pissed someone off so they were told to make an example out of him. That's also assuming there isn't some kind of black and white legal opinion on this issue that makes it clear the SA's office has a slam dunk case.

Looks like its going to making landfall again south of Naples.

Key West was fortunate to have the storm say east of the Island, they didn't get hit too hard with wind but the surge is going to cause a lot of damage and some of the other keys got it pretty bad. High tide is later this afternoon and its going to be bad for any of the low elevation areas from Naples to Tampa.

Miami and Lauderdale avoiding some of the heavier winds but they still won't see a peak until later tonight but its looking positive for them compared to what was expected.

Later today its supposed to hug the west coast and hit Tampa/Sarasota pretty hard. Tallahassee is also now expected to get pretty serious wind tomorrow morning.

The national hurricane center's 8:00am update just came out and contained some decent news. The storm has stayed over the northern part of Cuba longer than expected and the winds have died a little. Its a lower end cat 4 right now and has shrunk in size a little. It should be starting to make the move north northwest soon and they all say it will strengthen and get back to a high 4 or cat 5 once it is back over warmer water heading towards FL. FL will start feeling the winds later today and tonight will be a scary ride for anyone that stuck around in south FL.

Yes and no. Sure, it isn't as simple as just leave. But its like you can either stay in an area where you know you are going get a major impact from winds, surge, and lack of resources or you just drive away and get to a shelter or hotel for a few days. Can everyone do that? No. But most of the people that stay are completely able to leave. They just don't want to leave their stuff.

Lived in Miami for a long time; not there anymore but still in FL. This storm is going to be bad and it seems like not enough people are taking it as serious as they probably should.

There is an expected 10ft storm surge for much of the coast, even going up into the Gulf now. Then you also have essentially the entire state within the zone of super heavy winds and the track that will take the storm directly up the center of the state. People are treating this storm like its just another hurricane that is going to graze the cost but its not. Its huge, and stronger than what people are expecting it to be.

Many people I speak to are just staying in south florida and hoping for the best. This wasn't a great idea but its probably better than trying to leave at this point. They just need to get food and water and be ready to bunker down. There are going to be fatalities, and destruction but the real issue is that its going to take forever to clean up. People are going to be stranded without basic services for potentially weeks.

The most recent models all have it moving further west before heading north which is putting all the people from Naples to Tampa in the threat of a major storm that until today they weren't really expecting. The models earlier in the week had it grazing the east coast so the west coast of the state didn't really think they were going to get it so bad.

It has the potential of causing major damage to several major metropolitan areas and the state just doesn't have the resources to recover quickly if all the major cities get hit at the same time.

I'm scheduled to work for the emergency management service over the next couple days. If there are any FL or GA residents on CE that want updates let me know. I will likely have access to information pretty quickly and I will try to pass it on when I hear it.

Any other FL/GA/SC/NC people, prep for the worst and hope for the best. I hope I'm completely wrong but the next 5 days are looking like a major mess that not enough people are taking seriously.

You will probably still get that job. Hiring with most state jobs just take forever if you aren't like a high up type position. You should call the hiring person and tell them what is going on. They will call HR and try to speed it up.

If you do get the job soon you shouldn't move out voluntarily. Depending on where you live it usually takes a real long time for them to actually evict you. They can file papers and give you stuff that says they are going to evict you but they usually need a court order to physically remove you which takes a long time. You should stay until you get the job and then try to work it out with the LL.

A question I struggle with all the time...

I bought a zx10r a few years ago from a guy in west palm (bad idea). It was my first time riding a bike other than the ones they give you when you take the course to get your license (bad idea). Hit 156mph on the highway on the way home (bad idea). The bike could go faster but I was too scared. I got all the way back to Miami and crashed in an intersection a quarter mile from my home. Didn't get run over or hit anything, just went high side at about 25 because I didn't know what i was doing(bad idea). Bad concussion but no broken bones or anything like that.

I repaired the bike and sold it before ever riding it again because I saw it as a warning (good idea). I have been an adrenalin person all my life and push boundaries in everything. The thrill of going that fast on a bike is still the most awesome adrenaline rush I have ever had and I consider getting a bike about once a month since because of that feeling. For now I have decided being alive and able to walk is better though.

People can ride bikes safely. I'm not one of them.
