this is a boilerplate conclusion to a standard post-trial motion. i am guessing (without checking lol) that the judge's scheduling order provided for the holding off of post trial motions until both phases of the bifurcated trial were complete. if that's corect, then unlike all those times in trial when it was it was not up for challenge, this is the proper time for team trump to raise every possible defense in a motion for new trial/jnov so it is properly raised and preserved.
