And thats the point people are trying to highlight is if you are purposefully hiring based off race or sex then that means you arent hiring by merit.

Hiring off of merit is a fantasy. The idea that the "best"person for a job will get hired is something that has never been true. The reality is that there rarely is ever a person who is clearly the best and instead hirings are based off of subjectivity.
