It's both, technically. The type of trial depends on the relief the plaintiff seeks. In the case of the NY civil fraud trial, the NY AG wanted a disgorgement of ill-gotten gains of $250,000,000 originally and that amount grew to about $355,000,000 once all the facts were laid on the table toward the end of the trial.

The Trump Organization was already found guilty of fraud in a previous criminal trial, but Allen Weisselberg was the fall guy for that.
