The thing is it doesn't matter what the SCOTUS wrote about whether or not the SCOTUS gets to decide on whether an official act count is constitutional or not. Biden could theoretically have the current SCOTUS expelled replace them with anyone and have them decide after the fact whether or not it counted as an official act. Time to expunge the SCOTUS then.
