From what I've seen people say, this whole kerfuffle with the EULA is actually nothing. It's just TakeTwo using the same EULA for all of their games. The "root level access to spy on you" is actually for anti-cheat software for their multiplayer games. The data collection is for stuff like their sports games where they want to know who's buying what. There's been no update for the Borderlands games that would allow them to do this, there aren't dedicated servers for them to collect that info, and you would notice it in your PC's performance if it was doing that
