I think that upgrades the DUI to a felony.

Depends on the state, but even states that don't automatically do so can charge with felony child endangerment as well.

Like, in New Mexico you get felony charges starting on the fourth offense, assuming no aggravated charges or injury to persons/property.

Then driving with a minor (<13) without causing direct garm is an additional misdemeanor, but by precedent it is considered outright child abuse so it's not exactly a slap on the wrist.
