It's an odd charge.

Under the MPC manslaughter is when someone recklessly kills another as the result of extreme mental or emotional disturbance.

There must be intent for someone to attempt to commit a crime. A person cannot attempt to be reckless.

The police officer should absolutely be charged with a crime, some type of felonious recklessness, but if the police officer has a particularly savvy defense lawyer the prosecution may have a hard time making that charge carry water.

But it's a state I'm not familiar with, so there may be some underlying precedent there.
