But controlling what, exactly? A system for dealing with transgressors is the only way to maintain the social contract. And the social contract is by a wide margin the greatest structure for preserving liberty ever devised.


Take the 3 strike system for example. It unfairly punishes people who are more likely to commit multiple habitual crimes, and unfairly doesn't punish more serious crimes of passion that are less likely to occur. This is further amplified by how most (not all) habitual crimes are against the state, not against the peers... there is no risk of retaliation and no violation of social contract.
