Seems like there should be a clearer statute for this scenario, but I imagine the prosecutor knows what they're doing. Ok, there's more in the article: In the police affidavit, it states that Jones waived his Miranda rights and spoke with Homeland Security Investigations' Child Exploitation Investigations Unit, admitting that he directed the girls on what to do and wear in the videos So he was basically directing them for a porn shoot, makes sense.
