If somebody unjustly infringes on another's life (murder, sexual assault, anything harmful and permanent in some way), whether successful or not, but the intent is there, they forfeit their rights in my opinion. If there's sufficient evidence infallibly tying them to the crime (like video footage, multiple impartial witnesses to the act, or very convincing DNA evidence), just string 'em up in the town square upon the guilty verdict. It's cheaper and a better deterrent. Things that are not blatantly obvious would result in prison sentences. While a two-tier justice system is a little bit messy, it's necessary to prevent wrongful executions while streamlining the overall terrible process currently in use.
