The nurse refused to let police take a blood sample without a warrant. So she was arrested.
Detective Jeff Payne was sent to the hospital to collect vials of a patient's blood for a case. But when Payne asked, Nurse Alex Wubbels refused.
Hospital protocol says he had no right because:
- the patient was not a suspect in the case - the patient wasn't facing criminal charges - the patient wasn't able to give consent - the officer didn't have a warrant
"A blood draw, it just gets thrown around there like it's some simple thing. But blood is your blood. That's your property. And when a patient comes in in a critical state, that blood is extremely important and I don't take it lightly."
