Do you think it's fair to keep him under sex offender registry?


22 y/o Eric Daniel Gray from Washington had his SEX OFFENDER status upheld by a 6-3 vote after he was found guilty of child pornography when he was 17 and sent a picture of his PENIS to a 22 y/o girl!!

He was indeed found guilty of second degree child pornography even though HE was the subject of the illicit photos.

He was convicted in 2012 after sending a woman who used to work for his mother a picture of his penis..and the girl who was 22 said that for a year she had been receiving phone calls late at night from someone who kept asking sexual questions

Then she got 2 texts that showed a man's penis and another asking "Do you like it bab? It's for you. And for your daughter babe"

She suspected it was Eric so she sent it to the police and were able to trace it back to him. He was initially charged with second degree dealing in decpitions of a minor engaged in sexually explicit conduct, harassment and indecent exposure, but the other charges were dropped.

Adults charged with child porn face up to 10 years but since he was in juvenile court, he got 30 days of confinement and 150 hours of community service.

But his lawyers appealed the decision since child porn laws were ambiguous and couldn't punish a victim of child porn for distributing it.

This case drew national attention for the potential ramifications of minors sexting each other as there's a question if they would be guilty of child pornography as well.

But the Supreme Court said minors sexting each other was not an issue here as he was clearly in violation of state's child porn law..

They said "Because he was not a minor sending sexually explicit images to another consenting minor, we decline to analyze such a situation. The statute here is unambiguous. A person is any person, including a minor. Images of a minor are images of any minor. Nothing in the statue indicates that the person and the minor are necessarily different entities.

Eric has Asperbergers and is a registered sex offender and instead of sending him to prison, he seeked medical and therapuetic treatment.

Is it fair to keep him under sex offender registry?
