Mel Gibson and Kevin Spacey both spent five years out of work. Maybe it's not enough of a punishment, but they didn't go completely unpunished. As for Will Smith's punishment - that is being enacted by a private organization at their own discretion, and they aren't keeping him from picking up any new projects. In fact, he has more projects in the works right now than the other two combined.
