There are literally no legal waitress/server jobs that are allowed to pay lower than the state minimum wage if tips are short.

For example if the state minimum wage is 7.25, the local grocery store cashier is required to be paid 7.25/hour. The waitress is required to be paid that as well if tips are short.

There's a wage waitresses are paid IF they are tipped. Once again, if tips are short, employers are legally required to be pay whatever the difference is at 7.25/hour.
What that means is a waitress who worked 40 hours would legally expect at least $290 either from her employer or from tips.

Yet, people like you keep believing this misconception that they can legally go home with less. It is literally illegal to pay less. Once again this massive misconception that "if you don't tip the waitress, they will legally get paid less than minimum wage" is not true.
The misconception that it's the customers responsibility to make sure they're paid more than minimum wage is not true. Nor is the service industry entitled to a tip.
Lastly, the misconception andor attitude that the service industry is the only ones suffering is a massive misconception.

You are more than welcome to place these people on a pedestal. You are more than welcome to tip them if you want to. It doesn't change the above that so many keep falsely believing.
