He is in no way obligated to punish the second guy, the law allows him to, but he does not have to. He might choose to let him of with a warning or even just ignore it altogether.

Many laws are a framework that allows the police to apprehend "criminals", not the obligation in itself to apprehend every single breaker of every single little law. Some laws are meant as a deterrent, that are only rarely prosecuted to set an example. Some just exist to apprehend someone causing a dangerous situation (pretty sure jaywalking falls here) and some are even blankets to grab big criminals they could never get anything else to stick to (say tax evasion).

The law is a tool, not the obligation.
