They have no duty to design for the safety of pedestrians being hit by a fucking car. Their obligation is to design for the safety of the car's occupants. They have an obligation to not make the front bumper a giant bayonet, sure. But if a pedestrian is getting hit by a car, all assumptions are out the window. The rules of the road have been violated somehow by either the driver or pedestrian, putting the pedestrian in grave danger.
