Juvenile status exists as a means of diminishing the consequences for kids who make silly, immature mistakes, so that they can learn from those mistakes instead of having their lives ruined as a result. When the minor in question demonstrates that they know full well what the consequences of their actions are, though, or commits such a heinous crime that passing it off as a mistake would be unreasonable, they get tried as adults. The existence of juvenile status doesn't mean there can't be exceptions to it in exceptional circumstances, which I'd say this case qualifies as.


...and up until around the age of 25, the human brain is still developing and people are more likely to engage in impulsive, reckless, and illegal activities which, by the way, is one of the reasons we keep alcohol away from minors. While you could very well argue that the minor knew what he was doing -- in the sense that he had enough awareness to consider it, or jokingly think about it, as rape -- you'd be pretty damn hard-pressed to claim that he was in full awareness of the consequences, considering he was heavily intoxicated which further compromises brain activity. If he was doing it stone-cold sober then you *might* have an argument for adult status, but juvenile status exists for juveniles. And if you feel that punishments for juveniles aren't punitive enough, then add punishments for juveniles instead of upticking people to adults. Or, again, just abolish juvenile status.

But this is the exact reason we need to stop treating teens like kids and dole out the proper adult punishment for real life crimes. Teens age fourteen and up need to not just get a slap on the wrist.


Should start earlier than that, really. If a 12 y/o commits a murder or rape, they shouldn't get a slap on the wrist either.
