Anyone would have called it murder if he were successful and with no legal way to prove prior intend, the charge would be some form of manslaughter, so how could this not be attempted manslaughter?

Edit: Googling just taught me the term "Constructive Involuntary Manslaughter", so the attempted form of that? I mean, there has to be some legal charge the prosecutor could come up with, that makes sense and that also makes it very clear you do not attack a kid as an adult?
