It's not necessarily a matter of mods being blind to the tactic.
It's just not innately a bannable offense when worded carefully.

That's really the point of it, by being an attempt to mess with other posters while tiptoeing around getting busted for it. The more competent mods are well aware of the tactic, but there's little they can do about it before it breaks the ToS...

Don't get me wrong though. I'm certainly not going to tell you every mod has infallible judgment on what's a violation or hasn't let their personal bias get in the way of objectivity. Someone exercising their authority in such a rash and unreasonable way would likely also fall for something as childish as sealioning.
