The problem is that I'm not sure one can truly extort someone if the extortion in question simply comes from his/her neutral state inaction. Because at its core it isn't a threat. It represents someone asking for something in exchange for doing something the person otherwise has no obligation to perform. In this case it is asking for something super shitty. I'm in no way endorsing this action or pretending it isn't morally abhorrent, but I'm not sure it qualifies as rape through duress. This was discussed on an episode of It's Always Sunny. Long story short, metarape is still rape. The issue with "The Implication" is that it still took active action from Dennis to maneuver the women into a position where they couldn't say no. In this scenario, the proposed-Batman stand-in is taking no action at all. The only reason he is in the circumstance he is in is because Penguin kidnapped Batman (something he had no role in) and Batgirl approached him to be stand-in for Batman (something he had no control in). Is it truly possible to coerce someone through inaction when you had no part in the events leading up to it? Again this is not assessing the moral aspect of it.
