Instead the articles of impeachment were just voted on in committee without this. That is a part of an ongoing criminal investigation. That does not just get thrown around willy nilly. Especially if the prosecutor believes it advantageous to hold on to until the last possible minute dictated by law, and even then the only other person that will get to hear it is the defense.
