Unless you can point out where in the ToS (or whatever they call it now) it states "You can't close your account while another is Warned or Purg'd." I submitted a closure form while suspended and the reviewing admin said "this is abuse of the form because you can't close an account that is suspended or in purgatory" or something to that effect. It was worded rather rudely but I did not get into any trouble for the alleged "abuse of the form."
