Well, the law states "A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge." They didn't see him commit a crime in their presence and they said he matched the description of the person on the video which is a probable suspicion and not immediate knowledge. Which is even worse, since none of the surveillance video the news has been able to get that were supposedly of him are actually him. The only video that seems to be of him is the one were he trespassed into a house the same day but did no other crime.
